Show moreIn 2017 hebben drie (quasi-)juridische procedures plaatsgevonden over de arbeidsomstandigheden van migrantenwerknemers die in Qatar de stadions en dergelijke bouwen voor het wereldkampioenschap voetbal van 2022. Ondanks het feit dat er in Qatar geen vakbondsvrijheid is, spelen vakbonden in alle drie de procedures een cruciale rol. De analyse van de procedures toont aan dat in bepaalde situaties, zoals die in Qatar, quasi-juridische procedures succesvoller kunnen zijn dan een traditionele procedure bij een rechter. Ondanks het feit dat veranderingen zijn aangekondigd en ingezet is dit nog maar het begin van een lange weg. Maar eenmaal ingezet lijkt teruggaan niet meer mogelijk. Show less

Show moreThe award of the 2022 World Cup football to Qatar is highly controversial because of the human and labour rights infringements due to the Kafala-system. The argument in this contribution is though that it has also brought something good, namely it created the momentum for change, in particular, to abolish the Kafala-system. It is difficult to enforce such change through judicial review, as is illustrated by the case FNV c.s. vs FIFA. Soft law procedures, on the other hand, which are based on dialogue, trust and commitment are able to set changes in motions, which is illustrated by the Art. 26 complaint initiated by twelve delegates of the ILO against Qatar and the Specific Instance with the Swiss NCP initiated by BWI against FIFA. This contribution describes the consequences of the Kafala-system, explains why FIFA also fulfils a role in this, even though it concerns the law of the sovereign State Qatar, describes three cases addressing the poor circumstances of the migrant workers in Qatar, and concludes that for these kind of situations soft law proactive processes may be more effective than hard law retrospective judicial review. Show moreIn haar column in TRA 2016/102 besteedt Burger aandacht aan de zaak die de FNV samen met twee vakbonden en een arbeider uit Bangladesh is begonnen tegen Wereldvoetbalbond FIFA. Kort samengevat is de claim van FNV dat FIFA ervoor moet zorgen dat er bij de bouw van stadions en andere gebouwen ten behoeve van het WK voetbal 2022 in Qatar, betere arbeidsomstandigheden worden afgedwongen. Het is een goede zaak dat Burger hier aandacht aan besteedt. Het is geen alledaagse zaak en het is een mooi voorbeeld van een beweging op transnationaal niveau waarin werkgevers – zoals Burger ook aangeeft – in toenemende mate verantwoordelijk worden gehouden voor het respecteren van mensenrechten en fundamentele arbeidsrechten. Ze eindigt haar stukje met de vraag “Zullen we in 2022, met alles dat het aan mensenlevens en eventuele claims heeft gekost, dan gaan (weg)kijken?” Desgevraagd licht ze toe dat ze ons lezers hiermee aanspreekt met een gewetensvraag: Gaan we afwachten wat er gebeurt met de claim en daarna "gewoon" kijken; of kijken we nu niet weg en ondernemen we in de 5 jaren die nog resten tot 2022 meer acties om verdere uitbuiting en onderdrukking te voorkomen?
