Au moment où,... Show moreAu Mali, l'année 1991 marque la fin du régime autoritaire de la IIe République et le début d'une ère plus démocratique. En février 1993 est votée la loi-cadre sur la décentralisation. Au moment où, en 2001, les premiers juristes commencent leur aventure de recherche - qui aboutira à l'ouvrage collectif dont est tiré le texte de ce chapitre qui présente la démarche du livre -, les acteurs impliqués dans le processus de décentralisation sont encore en pleine période de rodage, et les premières confrontations issues de la décentralisation ont déjà eu lieu. Le Mali se présente donc comme un lieu des plus propices à la redécouverte du droit. C'est ce à quoi vont s'appliquer les juristes en question, en tenant compte des concepts de l'anthropologie juridique. Les chercheurs qui observent le droit vivant mettent en cause la conception moniste, dite étatique, du droit et reconnaissent l'existence simultanée de plusieurs systèmes juridiques ou du moins normatifs, dans une situation sociale donnée. En anthropologie juridique, un outil théorique vital est celui qui permet d'établir le rapport entre les autorités politiques (conseil des anciens, ONG, directions de l'entreprise) et les règles applicables, grâce aux deux concepts de champ social semi-autonome et d'arène politique. La décentralisation ne se déroule pas dans un vide institutionnel, et la législation peut induire des effets pervers, comme l'élargissement du fossé entre "allochtones" et "autochtones" et même une résurrection des autorités traditionnelles. Les disparités entre les approches du juridique "pur et dur" et les approches anthropologiques ont conduit à des "tatonnements" initiaux chez les juristes - qu'ils reconnaissent - dans leur cheminement vers la redécouverte du droit. Les contributions au livre témoignent de transformations, aussi bien au niveau du pays, qu'au niveau des juristes eux-mêmes. Show moreThe central tenets of this paper are that genocide and crimes against humanity are learnt practice, and that the seeds of the genocides that occurred in Namibia between 1904 and 1908 were sown in the Congo in the late 19th century. The paper argues that the violence perpetrated by German officers in the service of the Belgian King Leopold in the Congo Free State was formative for the manner in which German colonial forces came to wage war in Tanzania, Namibia and China. Show moreWorldwide, the drawing of water is rising faster than the growth in the world's population. Between 1900 and 1990 the world's population increased from 1.7 billion to 5.5 billion, while the total consumption of water in that time went up by a factor of 10, from 500 to 5,000 cubic km. This explosive rise is not just due to higher human consumption of water but is also the result of an increased supply as well as the expansion of existing economic activities and the introduction of new projects. By describing the water situation in the semi-arid Kajiado District in southern Kenya, this paper highlights the way specific interaction between political, juridical and economic processes has contributed to an upsurge in the pressure on natural water sources and available groundwater reserves. A history of Maasai landownership and water management initiatives in the area is followed by a comparison of efforts proposed and implemented to solve the numerous problems in water provision, focusing in particular on two types of water facilities - boreholes and shallow wells. The author argues that boreholes have contributed little to a solution for the growing water problems in Kajiado District. Instead, solutions should come from a merging of traditional and modern knowledge. [ASC Leiden abstract] Show less
