Show moreThis chapter explores the lawful contours of a growing phenomenon – the administration of criminal justice by non-state armed groups in territories under their control. It highlights a steadily mounting body of international practice recognizing the lawfulness of the ‘de facto’ processes as dependent on how – rather than by whom – justice is administered and considers the conditions that international law places on such justice. These include the core standards of independence and impartiality, fair trial guarantees, respect for the principle of legality and the nature of the crimes, which pose myriad challenges in practice in the context of de facto justice. Among others, the chapter flags the particular implications of increased resort by non-state actors (like states) to broad terrorism-related crimes as a basis for prosecution. Finally, as meeting the standards required of de facto justice will generally depend on external support, the chapter questions whether under international law states can – or in certain circumstances should – cooperate with or recognize such processes consistently with international law. In an area of dynamic legal and practical development, the chapter reveals a landscape that is evolving to meet the realities of the changing nature of non-state actors’ exercise of power and control, but where tensions, uncertainties and paradoxes remain. Show moreThe current body of law governing the conduct of police and prosecution during the investigative phase of criminal proceedings encompasses an enormous amount of rules. At the same time, a restrained approach with regard to the judicial supervisory role of investigative propriety is visible in case law while it remains unclear whether and to which extent other institutions have a supervisory role in this respect. This research looks at the current system of supervision on police and prosecutorial conduct in the context of criminal law proceedings from the viewpoint of criminal law standard. After all, creating rules for the conduct of law enforcement entails a certain obligation to ensure rule-compliance. After illustrating the complexity of the current legal framework as well as the complexity of reasons underlying its norms, the study focuses on the supervision of the conduct of police and prosecution. Based on the specific characteristics of the current Dutch criminal procedural law, the study develops a framework for an adequate system of supervision. The study then describes how currently supervision on police and prosecutorial conduct is organised and finally evaluates this in light of the requirements of adequate supervision as set out in previous chapter. Show moreIn het EVRM vinden we expliciete procedurele rechten als het recht op een eerlijk proces (artikel 6) en het recht op een effectief rechtsmiddel (artikel 13). Steeds vaker ontleent het EHRM ook procedurele waarborgen aan de verdragsrechten die op het eerste gezicht materieel van aard zijn. Het is van groot belang om op de hoogte te zijn van deze extra verplichtingen. In dit proefschrift worden de procedurele positieve verplichtingen volgend uit het recht op leven (artikel 2), het folterverbod (artikel 3), het recht op privé- en familieleven (artikel 8) en het eigendomsrecht (artikel 1 EP) in kaart gebracht. De nadruk ligt op de verplichtingen voor het (bijzonder) bestuursrecht. Bovendien wordt in deze studie gekeken in hoeverre de procedurele verplichtingen volgend uit deze materiële EVRM-rechten van toegevoegde waarde zijn ten opzichte van de procedurele eisen van de artikelen 6 en 13 EVRM. Daarnaast wordt in deze studie bezien of uit de toetsingspraktijk van het EHRM zelf nadere (indirecte) procedurele verplichtingen zijn af te leiden die in nationale procedures in acht moeten worden genomen. Dit onderzoek levert handvatten op die de nationale autoriteiten (bestuur en rechter) beter in staat stellen om EVRM-conforme nationale procedures in te richten en zo EVRM-schendingen te voorkomen. Show moreSince the 1990s, the number of National Human Rights Institutions (NHRIs) has grown rapidly worldwide. NHRIs are widely believed to be able to contribute to the realisation of human rights, by embedding international norms in domestic structures. Promoting Human Rights: National Human Rights Commissions in Indonesia and Malaysia addresses this issue by a comparative analysis of two NHRIs in Southeast Asia. It traces the development of both organisations since their inception, as well as their performance and effectiveness in three case studies regarding the freedom of religion, the right to a fair trial and the right to adequate housing. It reveals that the manner in which NHRIs address human rights issues differs between categories of rights, and that the promotion of international human rights standards is often hampered by the contestation of these norms, both within and outside of the organisation. At the same time, this study highlights some of the contributions the NHRIs have made to the realisation of human rights in challenging circumstances. The author therefore argues that NHRIs play a crucial role in making human rights an integral part of both the state and society. Show less

Show moreDit onderzoek gaat over de toetsing door de rechter van milieubesluiten, bijvoorbeeld een besluit van de gemeente tot het verlenen van een milieuvergunning voor een voetbalstadion. Tegen een dergelijk besluit kunnen belanghebbenden beroep aantekenen bij de Afdeling bestuursrechtspraak van de Raad van State. Deze rechter kan bepalen dat de vergunning in stand blijft, maar kan deze ook vernietigen, bijvoorbeeld omdat onvoldoende onderzoek naar de gevolgen voor de luchtkwaliteit is gedaan. Bij een dergelijke uitspraak wordt nogal eens de vraag gesteld of de rechter wel voldoende ruimte aan de gemeente laat om tot een eigen oordeel of afweging te komen. Het gaat hierbij om de vraag hoe indringend de rechter een overheidsbesluit moet toetsen. Ter beantwoording van deze vraag bespreek ik de verhouding tussen wetgever, bestuur en rechter, zowel meer in het algemeen als specifiek in het milieurecht. Daartoe analyseer ik het toetsingskader van de Wet milieubeheer en bezie ik kritisch de rol van de in de praktijk zeer belangrijke pseudo-wettelijke milieurichtlijnen. Mede op grond van een empirisch onderzoek naar 200 uitspraken concludeer ik dat de Afdeling in lang niet alle gevallen een juiste toetsingsmaatstaf aanlegt. Het voorgaande gaat over de verhouding tussen de rechter en het bestuur (als vergunningverlener). Een tweede belangrijk onderdeel van mijn onderzoek betreft de verhouding tussen rechter en deskundige. Omdat in milieugeschillen vaak technische vragen spelen, wint de rechter in veel gevallen advies in bij een deskundige. Hierbij rijst de vraag hoe de rechter bij zijn streven het geschil inhoudelijk te beslissen, kan voorkomen dat hij blind vaart op het deskundigenrapport. Ter beantwoording van deze vraag beschrijf ik zowel het theoretisch kader als de praktijk van de deskundigenadvisering in milieugeschillen, mede in het licht van artikel 6 EVRM (eerlijk proces). Op dit punt concludeer ik onder meer dat, uit het oogpunt van hoor en wederhoor, het deskundigenrapport eerst in concept aan partijen zou moeten worden voorgelegd, voordat de deskundige het naar de rechter stuurt. Een andere conclusie is dat de rechter duidelijker moet aangeven op welke passage(s) van het deskundigenbericht hij zijn oordeel baseert. Show less
