But with the emergence of increasingly complex multi-level and multi-stakeholder governance structures, and an increasing amount of delegation of public powers and tasks to both public and private non-majoritarian bodies, safeguarding public accountability has however become an increasingly complicated endeavour. This is not the least to be seen in the EU, where discussions about the EU's democratic deficit often centre around questions of accountability, with the accountability of non-majoritarian and (semi-)independent EU agencies being of particular concern. This dissertation focuses on how institutional EU account-holders execute their account-holding roles, in particular vis-à-vis EU agencies. Findings indicate that EU account-holders, within the constraints of their specific account-holding roles, are visibility-seeking organisations looking to take centre stage. This has important democratic accountability implications: Does the visibility-seeking behaviour of account-holders lead to low(er)-visibility agencies and issues escaping democratic scrutiny, or does it push account-holders towards going above and beyond their formal account-holding obligations. These two cases bring to light different behaviours of the judge in offering legal protection to fundamental rights. The analysis of these cases in the Dutch model, in which there is no judicial constitutional review, is enlightening about the new challenges faced by the State -climate change and the advent of the digital era- and the need to rethink the theory of separation of powers aiming to offering effective legal protection to fundamental rights. Show moreLike borders, refugee protection settings beyond the EU often serve as testing grounds for technologies. This article takes a socio-legal perspective to show how humanitarian experimentation in these contexts is made possible through different, interacting challenges to sovereignty. It argues that the understanding that actors or their positions are “exceptional” allows for and justifies data practices that would otherwise not be legally permissible. Examples of data practices in refugee protection settings are connected to work in geopolitics, science and technology studies, and sociology of law.The article shows how the position of the United Nations High Commissioner for Refugees (UNHCR) as negotiator on behalf of refugees and an emergency-driven techno-solutionism not only interacts with the already precarious legal context most people seeking refuge find themselves in. It coincides with the legal positioning of International Organisations and with citizenship-oriented conceptions of privacy, further constituting people seeking refuge as (digital) rights optional. This is problematic not least because of concerns about adequate data protection or the implications of bias. Data flows and algorithms are generative of the politics of contemporary societies, implying that the structural undermining of digital rights of people seeking refuge in the present can also hinder their access to rights in the future. In literature there is predominant view that accountability is threatened by the existence of transgovernmental networks. This dissertation takes a micro-level approach by focusing on participants of transgovernmental networks, to understand the dynamics of accountability in this setting. This dissertation makes use of theory building and testing. A theoretical model links the function and governance style of a transgovernmental network to the type of accountability that can be expected. Four distinct empirical cases show that there is a link between the level of formalisation of a governance style and the extent of control. Moreover, this research shows that the function of a transgovernmental network is indicative for the source of control. Show less

Show moreAims To develop a suite of quality indicators (QIs) for the management of patients with ventricular arrhythmias (VA) and the prevention of sudden cardiac death (SCD). Methods and results The Working Group comprised experts in heart rhythm management including Task Force members of the 2022 European Society of Cardiology (ESC) Clinical Practice Guidelines for the management of patients with VA and the prevention of SCD, members of the European Heart Rhythm Association, international experts, and a patient representative. We followed the ESC methodology for QI development, which involves (i) the identification of the key domains of care for the management of patients with VA and the prevention of SCD by constructing a conceptual framework of care, (ii) the development of candidate QIs by conducting a systematic review of the literature, (iii) the selection of the final set of QIs using a modified-Delphi method, and (iv) the evaluation of the feasibility of the developed QIs. We identified eight domains of care for the management of patients with VA and the prevention of SCD: (i) structural framework, (ii) screening and diagnosis, (iii) risk stratification, (iv) patient education and lifestyle modification, (v) pharmacological treatment, (vi) device therapy, (vii) catheter ablation, and (viii) outcomes, which included 17 main and 4 secondary QIs across these domains. Conclusion Following a standardized methodology, we developed 21 QIs for the management of patients with VA and the prevention of SCD. The implementation of these QIs will improve the care and outcomes of patients with VA and contribute to the prevention of SCD. Show less

Show moreNote: dissertation is under embargo.Following the establishment of the United Nations, states have increasingly conferred powers on international organisations, thus raising the significance of such organisations in international affairs.Private parties are increasingly impacted by the actions of international organisations. This underscores the need for a proper understanding of the accountability of such organisations and, more specifically, their responsibility in a legal sense. This dissertation concerns the liability of international organisations towards private parties (excluding the personnel of the organisation).As a rule, when an international organisation is sued before a domestic court, the former can claim immunity from jurisdiction. Accordingly, the dispute cannot be adjudicated by such a court. That is essential to safeguard the independence of international organisations.At the same time, international organisations often are under a treaty obligation to provide alternative remedies for the settlement of disputes of a ‘private law character’. It is submitted that in discharging that obligation, organisations should adopt a systematic approach in conformity with the rule of law. That is needed both to bolster the jurisdictional immunity of such organisations and to increase their legitimacy. The dissertation sets forth proposals based on such an approach. In doing so, the ultimate purpose of the study is to contribute to enhancing the effectiveness of international organisations. Show less

Show moreThis chapter describes and analyzes the truth trial against Volkswagen for its role in the detention, torture, and disappearance of workers during the Brazilian dictatorship (1964-1985). This chapter uses the Archimedes’ Lever model to trace the evolution of the corporate accountability process since the country's democratization, through the establishment of the National Truth Commission (CNV), up to the negotiations between the company, the workers, and the Public Prosecutor’s Office (MPF) that reached an agreement in 2020. This case has seen mobilisation from unions and institutional innovators pushing for accountability, as well as a certain level of cooperation from the company, but it also faces strong veto players and a change in context with the election of Jair Bolsonaro as president in 2018. We conclude with notions of what the Volkswagen case has to offer to understand corporate accountability and transitional justice, and the enormous hurdles it faces in achieving those goals. Show moreThere has never been a more pertinent time to discuss the accountability and the legal responsibility of Frontex, the European Border and Coast Guard Agency, for fundamental rights violations. In a period that hosts the first legal actions vis-à-vis the agency and a series of relevant non-judicial investigations, including by the European Parliament, this dissertation aims to address the main problem underlying these accountability efforts, namely the ‘problem of many hands’. As conceptualised by Dennis Thompson, this problem is where the multiplicity of the actors involved obscures the various responsibilities and creates gaps in accountability.To address it, this work contests the dominant ways of looking at the concepts of responsibility and accountability, and reimagines them for their optimal function.It adopts a holistic approach, taking into account not only judicial, but also other forms of accountability, studying not only EU liability law, but also other legal remedies before the CJEU, the ECtHR, and domestic courts, building bridges between international and EU law, and traveling from the empirical to the conceptual, to the normative, and from there to the applied.It creates the foundations for the accountability of the agency inside and outside courts, within the EU borders and beyond. Show moreInterest groups are perceived as vehicles that can enhance the legitimacy of public institutions at the national and supranational level. However, the potential of these organizations to enhance democratic representation is often questioned and has rarely been systematically analysed. In this article, we examine the under-researched area of interest group accountability, a key component for groups to realize their democratic potential. To do this, we take an organization-centric and top-down perspective and develop a tailored analytical framework including three key dimensions—information, discussion and consequences. Drawing on data from a large-scale survey of interest groups active at the EU level, we find considerable variation in the extent to which groups demonstrate practices related to these three accountability dimensions. Furthermore, while receiving funding from EU institutions does not have any significant effect on interest group accountability, we find that organizations representing businesses interests more frequently develop accountability practices related to the dimensions of discussion and consequences, whereas citizen groups are more focused on the information dimension. Show moreThe United Nations has established at least thirty international commissions of inquiry to examine situations of mass atrocities. These bodies resemble legal processes in some ways, while remaining non-legal in others. This research explores UN atrocity inquiries’ turn to international law and their navigation of considerations of principle and pragmatism to discern their identity in the international legal order. The thesis traces the inquiry process from establishment and interpretation of the mandate to legal analysis, production of findings and recommendations. The research finds that the turn to international law fundamentally shapes the roles and functions of UN atrocity inquiries. Commissions seeking to promote accountability and the rule of law are linked to truth-seeking, giving a voice to victims, condemning violations, raising alert and provoking corrective action. Yet, commissions’ interpretations of their mandates, legal analysis, findings and recommendations reveal an awareness of their liminal position between international law and politics. Their informality renders commissions well-placed to propose innovative legal interpretations, draw attention to violations and catalyse follow-up, while space is retained for diplomatic approaches and discretion in implementing recommendations. In short, UN atrocity inquiries continuously navigate between realms of law and politics, with the equilibrium shifting in different moments and contexts. Show less

Show moreIn the latest twenty years we have witnessed an exponential proliferation of international commissions of inquiry mandated to investigate serious violations of international law. However, the inquiry tool has been originally institutionalised at the beginning of the 20th century as mean of preventive diplomacy aimed at stating the facts for dispute settlement purposes. Since then inquiries have significantly evolved into mechanisms that denounce and shed light on serious violations of international law in order to provoke a response by the international community. What are the underlying causes of this new role and of the recent surge of inquiry commissions? Should commissions of inquiry be viewed as merely fact-finders or as law-applicable/adjudication bodies? Should their tasks be confined to finding the facts or may they perform more dynamic and political roles such as raising alert and provoking reactions? What (arguably) should be the role of commissions of inquiry in the criminal accountability process? These and other questions are the core of this academic contribution which, through a comprehensive analysis of the work and practice of commissions of inquiry, aims to shed more light on a topic that has increasingly become the focus of intense debate among academics, practitioners and international decision-makers. Uit dit onderzoek blijkt dat machtenscheiding een systeem is dat zijn waarde door de eeuwen heen heeft behouden en flexibel genoeg is om te worden aangepast aan de eisen van de tijd. In Nederland heeft nooit een absolute scheiding tussen wetgevende, uitvoerende en rechterlijke macht bestaan, maar is er gestreefd naar machtsevenwicht. Recent ontstane nieuwe instituties binnen de 'oude machtenleer' zijn onderzocht: de Raad voor de rechtspraak, onderdeel van de rechterlijke macht en het Onderzoeks- en Verificatiebureau, ter versterking van de controlefunctie van de Tweede Kamer. Nieuw is de opvatting dat de media, onderdeel van de politiek en het politieke besluitvormingsproces, beschouwd moeten worden als (privaat)publieke macht. Conclusie is dat de Raad voor de rechtspraak vooralsnog functioneert als ware er sprake van machtsevenwicht. Het Onderzoeks- en Verificatiebureau van de Tweede Kamer blijkt geen 'macht in de macht'. Om de media in ieders belang sterk te houden moeten zij zich als publieke macht gedragen. Om machtsevenwicht te bereiken moeten de media enerzijds verantwoording afleggen over gemaakte afwegingen, anderzijds moet hen bescherming worden geboden tegen andere publieke machten. Show moreThis dissertation focuses on social dilemmas, and more specifically, on environmental uncertainty in these dilemmas. Real-life social dilemma situations are often characterized by uncertainty. For example, fishermen mostly do not know the exact size of the fish population (i.e., resource size uncertainty). Several researchers have therefore asked themselves the question as to how such uncertainty influences people’s choice behavior. These researchers have repeatedly concluded that uncertainty is detrimental to the collective because it induces over-harvesting. The present dissertation aims to provide a more comprehensive view on uncertainty in social dilemmas. Whereas earlier research has primarily investigated how uncertainty influences harvesting decisions, this dissertation also focuses on how environmental uncertainty affects interpersonal processes. This dissertation introduces a perspective that argues that environmental uncertainty hampers the application of the equal division rule, which in turn influences how group members interact with one another. In six chapters, I elaborate on numerous implications of this notion. By focusing on three key aspects of interpersonal processes (i.e., tacit coordination, justification pressures and interpersonal emotions), and by testing my ideas in seven empirical studies, I demonstrate that the effects of uncertainty are much more differentiated than is portrayed in earlier research.
