Show moreThe Netherlands has endorsed a unique system regarding the management, disclosure and screening of criminal records. Disclosure to third parties is strongly restricted, yet all (potential) employees can request a government agency to provide a risk assessment − known as a Certificate of Conduct (‘VOG’ in Dutch) − for every kind of employment application to determine whether they are fit for a given job. This article explains how and why this Dutch policy approach, deemed respectful of individual privacy rights, can nonetheless go hand in hand with the promotion, proliferation and pervasiveness of criminal record screening. It challenges the often dichotomic approach of the comparative literature on criminal record policies and helps understand that privacy protection alone cannot be fully equated with the rehabilitation and re-entry in society of people with a criminal history. Although the Dutch criminal record system avoids any unnecessary publicity of criminal record data, it nonetheless triggers adverse impairments on reintegration processes through stigmatisation and exclusion resulting from the ubiquitous use of Certificates of Conduct in the labour market. This questions the promotion of the Dutch screening instrument as an exemplary model for criminal record information sharing within Europe. Show less

Welke lessen kunnen er getrokken worden uit deze ervaringen met telehoren en welke principiële bezwaren en praktische obstakels moeten overwonnen worden om het telehoren een structurele plek in de strafrechtspraktijk te geven? Dit zijn urgente vragen in het licht van de aangekondigde voorstellen om telehoren een vaste rol te geven in de strafrechtspleging. Auteurs doen verslag van empirisch onderzoek dat is verricht naar de inzet van digitale middelen ten behoeve van het horen van verdachten en de effecten daarvan op positie van verdachten in het strafproces. Show moreThis preliminary study had to address a number of key questions: What is the expected effect on the individual concerned and on society as a whole of introducing into the legislation the option of imposing a substitute community service order on an offender who fails to pay a fine issued under criminal law? What positive and negative consequences can be expected, and what are the grounds for these expectations? These questions have been studied by consulting relevant literature and documents, including parliamentary documents, analysing Central Judicial Collection Agency (CJIB) data and conducting 23 interviews with key individuals and experts within criminal law for youth and adult offenders. De menselijke maat komt ook door incidenten en een sterke oriëntering op risicovermijding in de verdrukking, hetgeen des te meer kan wringen nu de hoogste bestuursrechters slechts over het absolute ‘topje van de ijsberg’ rechtspreken.
