Show moreThis research is about the representatives of the count of Holland and Zeeland in the Habsburg period (1483-1558).The questions which are addressed concern who the representatives of the count were, how they acquired their office, what their duties were and how they performed them, and what this meant for the relationship between the prince and his subjects. In a society which could not yet fully function with strict rules imposed by the centre, the officers played the role of brokers, smoothing the relations between prince and subjects through the use of informal means. The first half of the sixteenth century saw a stricter living by the rules, formalisation of procedures and the separation of the different spheres of influence, slowly carried out and sometimes reversed again in a complicated dance between prince, Council and States. During that process the foundations which held the relations between sovereign and subjects together, the possibilities of princely officers to act as intermediaries, were gradually eroded. Those foundations were needed more than ever in a time when taxes, trade impediments and the prosecution of heretics caused most feelings of resistance among the subjects. When William of Orange led the Revolt in 1568, the count lacked a group of Holland officials who could form a successful counterpoise. Show less

For those who do not know how to read and write, the process starts with the office of Mayor de Vara del Ayuntamiento. For those who do, with that of Síndico Municipal. In these offices they start speaking the Sa’vi, when delivering messages to the citizens. If one does not have the necessary experience or knowledge of this special way of oral expression, one asks the immediate superior in the same line of duty to help out and teach it. If that is not sufficient, one goes to a trusted experienced and respected elder in the community to learn from him the usages, times and places of this discourse. The apprenticeship commences with short messages, e.g. thanks for an invitation.The central question of this study is: How are the ideas and values of a culture, specifically of the culture of Ñuu Savi (the Mixtec people in Southern Mexico), transmitted and perpetuated? This prompts exploration of a specific genre of oral literature, the Sa’vi or “ceremonial discourse”, which plays a prominent part in the construction of community and cultural memory. Although this genre is obviously important for many studies of Mesoamerica, it has so far received little attention. Consequently our first task was an adequate representative documentation, both of the texts and of their contexts, with their linguistic and anthropological dimensions. With the help of many local people a corpus of discourses (“parangones”) from Yutsa To‟on (Apoala), situated in the Mixtec Highlands in the Mexican State of Oaxaca, was taped, transcribed, translated and commented upon. An important aspect of this research is the historical dimension, because from the same region a number of precolonial pictorial manuscripts has been preserved, in which Yutsa To‟on also appears prominently. As these manuscripts must also have functioned as a basis for public discourses and performances within a ceremonial context, the question arises whether there is a relation and continuity between the pictographic scenes in those codices and the Sa’vi of today, in composition, style, contents and social function. The ceremonial language is employed in solemn acts of family or community life – such as baptism, compadrazgo, asking the hand of a woman, traditional weddings, the receiving and honouring of municipal authorities, thanksgiving for the harvest to Mother Earth, healing ceremonies, mayordomías etc. In all of these events the discourse invites reflection through counselling and exhorting respect and mutual support among the individuals, searching for solutions to problems by making explicit or implicit references to the ancestors and their norms of conduct and living together. The Sa’vi is also the language in which to address the gods, and to refer to different sacred symbols, such as the Tukukua, Itakutsa, staff of office, mat and throne (el Yuhuitayu analyzed by Kevin Terraciano and Angeles Romero), the Rosary, and the authorities themselves (Tade’e), as those who carry the responsibility for the well-being of the people. Thus the discourses fulfill several objectives at the same time, expressing normative and explicatory ideas about nature, religion, history, politics, morality etc., and exposing the knowledge of earlier generations and different segments of society. The Sa’vi is interactive: on the one hand it may be an opening discourse or a responding one , on the other there is always the relation between the canonical message and the specific moment in which it is pronounced (cf. RAPPAPORT 1999). Susana Cumming y Tsuyoshi Ono stress that discourse and context generate and limit each other (van DIJK 2001:174). As a specialized speech genre Sa’vi is the reserved domain and competence of a the group of elders known as Tanisa’nu, who have accumulated social prestige and moral authority because of their community services, i.e. by passing through the hierarchy of social, communitarian municipal and ecclesiastic offices (cargos), which has provided them with a detailed knowledge of customs and prestige because of their positiveFrom the familial and personal environment we move on to the social and political life of the town, focusing on the discourses pronounced at the occasion of the change of municipal authorities and discussing the meaning of the symbols used and referred to in this context, e.g. the bush of flowers (Chapter V). We pay attention to the complex social organisation, which is connected to the worldview, rooted in the precolonial period but remodelled later under Catholic influence. This aspect of syncretism is even more present in the religious festivities with their corresponding mayordomías (Chapter VI). All these activities imply also the participation of family members, compadres, authorities, neighbours and other helpers, which has to be solicited and for which thanks is given for by a Tanisa’nu with adequuate phrases. Obviously the Sa’vi is also used during ceremonies that clearly have a precolonial background, such as the celebration of the Days of the Dead. The abovementioned social contexts, with their corresponding symbolisms, are, indeed, also present in the Mixtec codices. With a deeper understanding of the form, function and contents, we may achieve a more adequate reading of the pictorial scenes and propose new interpretations of specific elements. In Chapter VII the following important examples are analysed: - the staff of office as symbol of power, - the throne and the mat as signs of the unity of the community and civil authority recognising the seated couple as Tade’e, “father and mother of the people”, - the flint knife as symbol of justice, - the processions of protagonists as an expression of social organisation, comparable with the contemporary authorities lined up with their staffs, - the symbolism of the four directions that is manifest in the so-called Venus Staff, corresponding to the contemporary wooden frame known as Tukukua, - the bush of flowers (Itakutsa) as part of the public recognition of power, - the Sacred Bundle as a container of abstract force and luck, - elements of the sacred landscape of Apoala itself, which appear in the codices, - the symbolic meaning and ritual use of maize, epitome of the Mesoamerican cosmos. Each of the chapters of this dissertation moves us to reflect on the use of the language: this analysis makes us understand its grammatical richness, but the focus on ceremonial speech is especially significant as it makes us aware of the persistence and continued transmission of cultural memory and philosophy among our peoples. Observing that this is the very language which our ancestors used to express their thoughts in the different codices they painted before the Spanish conquest, we not only discover that through the surviving manifestations of this special language, Sa’vi, we understand better several important passages of those ancient books, but also the continuity of that ancient thought and worldview in our present-day perspectives and identity. On the other hand, this language is dwindling: the new generations generally do not know and do not want to speak the common Mixtec language, much less the Sa’vi. Among the causes we may point to poverty (exploitation), discrimination, migration, alienating education with its modernisation „Western‟ style, the mass media, acculturation to „Western‟ thought, the lack of transmission and teaching of our own language and otherfactors that together provoke the displacement and extermination of the Mesoamerican languages, and in fact endanger the languages of all indigenous peoples of the planet. In this context we may understand the lack of consciousness and even apathy among the cultural descendants, which contributes to the further erosion of forms of knowledge, meanings, historical and philosophical values still existent in indigenous communities. To confront this problem, the challenge is that those of us who are conscious of our culture take an active approach, creating more reflection and understanding of this matter and of our cultural heritage. Show moreThis research study uses the Cultural Theory as a theoretical framework to analyze the governance culture, values and strategic perceptions of top civil servants in the Netherlands. This results in a cognitive map, based on the response to a questionnaire that was sent to the entire population. The majority of them (59 %) prove to adhere to the egalitarian world view stressing the equality of people and attributing a great significance to networks as regulatory social mechanisms. A substantial minority (24%) clings to the individualistic world view ascribing the highest importance to the individual and assuming that mutual relationships among individuals are shaped by contractual bonds and free market operations. Small minorities adhere to the hierarchical (12%) or fatalistic world view (5%). The majority also adhere to strategic perspectives like cooperation, a society-oriented professional role view, and an organic leadership orientation. Thus a set of shared values and beliefs shows up: an __esprit de corps__. This raises the question whether perhaps a neo-Weberian bureaucratic ethos is on the rise that is characteristic for the performance of top civil servants in a society that they themselves perceive primarily as an egalitarian network society. Show moreIn public debate and academic discussions about Islam in Western society, reference is often made to the role of the imam in processes of acculturation of Muslims. Throughout these debates, we come across the important question of how imams transmit Islamic norms and values to Muslims living in secular, non-Islamic societies. This descriptive-exploratory research considers this question specifically looking at the role of the imam in the local mosque in the Netherlands. This dissertation describes and analyses the external perspective of the views circulating in the public debate on imams between 1993 and 2004. The internal perspective has been brought into focus empirically by describing and exploring his role, authority and influence in two mosque-communities and one Islamic student association. The internal perspective further divides into the perspective of the imam and the perspective of a group practising, mostly young and highly educated Muslims who grew up in the Netherlands. The imam finds himself in a field of tension between expectations from the majority society and expectations of the believers. The indicative findings from the internal perspective have been compared with the external views. The outcome of this comparison is used to clarify the ongoing public __imam-debate__. Show less

Show moreThis study analyses the economical and commercial development of Holland in the late Middle Ages, focusing on the fuel market and fuel trade. Energy was of vital importance to this society in which industry, trade and export were expanding rapidly. The brisk commercial and industrial development of Holland between the 13th and 16th centuries coincided with demographic growth and increasing urbanisation. Fuel markets in Holland developed in the 15th and 16th century from local to regional and inter-regional markets. Transaction costs were low, partly as a result of a fairly well-developed justice system and partly because an excellent infrastructure minimised the transport costs of these high volume products. Fuels other than peat were preferred only because of certain technological requirements or superior properties. Fuel markets in 16th century Holland were well integrated due to the import and export processes and a well-developed transport infrastructure. Municipal autonomy in Holland had led to inefficiencies in measuring systems, trade restrictions and tax advantages for certain groups. However by the 16th century many such impediments were reduced or removed. Show less

Show moreThis political biography analyzes the political influence of, and methods used by, P.W.A. Cort van der Linden (1846-1935), Dutch Prime-Minister from 1913 to 1918. While he was a Professor of Economics he developed a view of liberalism based on German idealism which also included a progressive use of Social Darwinism. This view was what he called “the theory of a higher sense of justice.” The application of this theory is evident in his legislation to protect children (1901) as well as in the constitutional revision of 1917. According to Van der Linden’s views, it was ‘a political necessity’ to introduce general male suffrage. He also made the future introduction of female suffrage possible, and, in spite of criticism from Kuyper, the leader of the Calvinistic antirevolutionary party, he made possible the equal treatment of private, denominational, and state schools. The non-partisan attitude of the Prime-Minister was also important for the maintenance of neutrality in the Netherlands during the First World War. Van der Linden stayed in close contact with Germany while Foreign Secretary Loudon spoke to the French. In addition to all these efforts, the Prime-Minister had to settle disputes within his cabinet, with commander-in-chief Snijders and with Queen Wilhelmina. Show less

Show moreThis dissertation studies trade and transport on the rivers Rhine, Waal and IJssel during the Late Middle Ages. These rivers were the main arteries connecting Holland, Flanders and Brabant on the one hand with Guelders, Cleves, J_lich and Cologne on the other hand. The study tries to establish the nature and volume of river trade at three 'measuring' periods during the 14th, 15th and 16th centuries. It seeks to explain both short-term fluctuations and long-term changes in the river trade during those centuries. Short-term fluctuations were often the result of warfare or meteorological conditions and did not alter river trade structurally. Long-term changes were induced by large-scale economic developments within North-Western Europe, such as the rise of Antwerp and that of Holland and Zeeland. Merchants and skippers from territories along the rivers, such as Guelders, Oversticht and Cleves, who had found a place within the Hanseatic League from the early 14th century onwards, could not compete with their Holland neighbours. Instead they focussed on a role as full time skippers or tried to find a specialisation or niche on the large markets of Holland, Zeeland and Brabant, selling Rhine wine or lumber from the German hinterland. If a document which is kept by one of the European Union institutions contains personal data the two right collide. Although this possible collision is apparent, it is not sufficiently addressed in the two regulations in which both rights are further elaborated (Regulation 1049/2001 and Regulation 45/2001). After an analysis of legal developments within the EU, case law of the European Court of Human Rights and the relevant national legislation of the 27 Member States, the author presents his views on how the balance between the two rights should be struck. Bij de behandeling van de leveringsformaliteit __bezitsverschaffing__ wordt onder meer aandacht besteed aan de __relativering van de levering cp__, en aan de levering door een houder. Vervolgens komt de levering bij voorbaat aan de orde. Hier worden vragen behandeld als: hoe vindt levering bij voorbaat plaats? Wat is rechtens indien een roerende zaak tweemaal bij voorbaat is geleverd? Ook de middellijke vertegenwoordiging bij de levering vormt onderwerp van onderzoek. Show moreDe Hoge Raad (HR) behandelt in cassatie gemiddeld 2500 strafzaken per jaar, vooral van individuele verzoekers. Hoe groot de kans is dat de HR casseert, is niet eerder onderzocht. De HR-jaarcijfers melden druk op de cassatierechter en gaan soms in op kwaliteit van cassatieschrifturen. Dit empirisch onderzoek (periode 1997 tot en met 2001) behandelt de vraag of en in welke mate cassatie voorspelbaar is. Voorspellingen zijn mogelijk bij ongewijzigde omstandigheden. ‘Behandeltijd’ – tussen bestreden uitspraak en arrest van de HR – is belangrijk voor de kans op cassatie van individuele verzoekers. Invloed van behandeltijd kan instroom van cassatieberoepen deels verklaren én in stand houden. Individuele verzoekers en openbaar ministerie (OM) hebben verschillende kansen op cassatie. Zij kiezen verschillende doelwitten en cassatiemiddelen die in verschillende mate ‘succesvol’ zijn. Individuele verzoekers wachten langer dan het OM op een oordeel van de HR. Individuele verzoekers richten zich in zeven van acht gevallen tegen correct gewezen uitspraken. In de onderzoeksperiode bleken verschillen in kans op cassatie naar herkomst en soort strafzaak. In dit boek wordt __n van die facetten nader belicht, te weten de toepasselijkheid. In de praktijk blijkt dat de toepasselijkheid van algemene voorwaarden vaak inzet is van een geschil tussen partijen. Dit is niet vreemd omdat de partij wiens algemene voorwaarden op de overeenkomst van toepassing zijn veelal de juridische troeven in handen heeft. Het onderzoek beoogt enerzijds inzichtelijk te maken volgens welke wettelijke en/of verdragsrechtelijke regels moet worden vastgesteld of algemene voorwaarden op nationale overeenkomsten of op internationale koopovereenkomsten van toepassing zijn. Anderzijds tracht het boek door zijn ruime aandacht voor rechtspraak, een antwoord te geven op de vraag of theorie en praktijk op het punt van toepasselijkheid van algemene voorwaarden met elkaar in overeenstemming zijn. In het boek wordt gesignaleerd dat de wettelijke bepalingen niet op een juiste wijze in de rechtspraak lijken te worden toegepast. De rechters zouden minder snel moeten aannemen dat algemene voorwaarden stilzwijgend zijn geaccepteerd door een wederpartij. Ook wanneer beide partijen algemene voorwaarden hanteren bestaat er onduidelijkheid over de precieze betekenis van de wettelijke regeling die daarvoor geldt. Wordt thans nog uitgegaan van de regel dat de algemene voorwaarden van de eerste verwijzer daarnaar gelden tenzij deze uitdrukkelijk van de hand zijn gewezen, in het boek wordt de stelling verdedigd dat bij strijdigheid van algemene voorwaarden, geen van beide sets van toepassing is. Wanneer dergelijke vragen moeten worden beantwoord in een context waarin een van de partijen in het buitenland is gevestigd, dan ontstaat er een kluwen aan verschillende internationale rechtsregels waarmee rekening moet worden gehouden. Deze worden lang niet in alle gevallen op een juiste wijze toegepast, terwijl het over grote belangen kan gaan. Uit de rechtspraak zijn thans geen __hard and fast __rules te destilleren aan de hand waarvan met zekerheid kan worden voorspeld wat de afloop van een eventueel geschil over de toepasselijkheid van algemene voorwaarden zal zijn. Also discussed are the civil procedural and administrative procedural law as the setting for the application of these articles, a number of characteristics and principles of both laws and the respective court__s task in the procedure. The recent (proposed) changes tot civil procedural law are discussed as well. Show moreThis thesis seeks to explore the landscape of state liability in England and the Netherlands. The history of state liability in the two countries is first told from a constitutional law perspective. Then two maps are drawn: one of English and one of Dutch law. Finally, a panorama of state liability emerges. Neither the private nor the public law perspective has been excluded from this thesis, which poses three major questions. First, which are the constitutional preconditions for state liability? Secondly, what strikes one most when the maps of the positive law on state liability in England and the Netherlands are compared, side by side? Thirdly, to what extent may the substantive law on state liability in England and the Netherlands converge under European influence? State liability is studied at four distinct levels. The first is constitutional in nature. It is about the state, its organisation and most particularly its subordination to the law. The second is that of the legal protection offered when public authorities overstep their constitutional powers. At the third level are drawn the general lines of the substantive law on state liability. The fourth level is the most concrete: it is that of the case law. Show less

Show moreGegevensverwerking is van essentieel belang voor de (justiti_le) politietaak. De maatschappelijke ontwikkelingen nopen de wetgever tot het vinden van een balans tussen het effectief waarborgen van de veiligheid van de burger enerzijds en de bescherming van de privacy van diezelfde burger anderzijds. Dit onderzoek beoogt duidelijkheid te scheppen omtrent de juridische en maatschappelijke mogelijkheden en onmogelijkheden van de verwerking van gegevens in het kader van de opsporingstaak. Onder meer voor het gebruik van datamining. Geconcludeerd kan worden dat aanpassing van de huidige wet- en regelgeving noodzakelijk is met het oog op een afdoende bescherming van de persoonlijke levenssfeer, waarbij de 'verwerking' van gegevens het uitgangspunt moet zijn. Tevens dient zo te worden voorzien in een betere benutting van de mogelijkheden die de huidige techniek biedt op het vlak van gegevensverwerking. De verantwoordelijkheden binnen de opsporing moeten duidelijk zijn en er dient te worden gestreefd naar een uniforme gegevensverwerking binnen de politie. Dit kan worden bereikt door een verplichte samenwerking en invoering (daartoe) van één systeem en/of het hanteren van een onderling eenvoudig uitwisselbaar bestandsformaat. Dit maakt een eenduidige en effectieve gegevensverwerking mogelijk en voorkomt versnippering van informatie. De voorgestelde Wet Politiegegevens komt in veel opzichten tegemoet aan de in dit onderzoek geconstateerde knelpunten. Show less
