Show moreTen years ago, the Single Supervisory Mechanism (SSM) was created, centralizing European banking supervision. In the SSM, the European Central Bank (ECB) cooperates closely with the National Competent Authorities (NCAs). The unprecedented degree of integration between NCAs and the ECB leads to supervision often being a joint exercise. SSM composite procedures are a specific type of such a joint exercise.Composite procedures culminate in a final ECB or NCA decision, yet are based on input from both. This integrated decision-making forms a paradox with the European system of judicial protection, which to an important extent remains to be organised dualistically. In short, national courts still review only national acts while the EU Courts, in principle, review only EU acts.This paradox raises concerns regarding effective judicial protection. This dissertation aims to investigate whether the EU principle of effective judicial protection is currently safeguarded within the SSM, particularly where it concerns composite procedures. It examines both the action for annulment and the action for damages, addressing the interplay between the EU and Dutch national legal framework. It is concluded that effective judicial protection is not always achieved. The dissertation therefore proposes several recommendations aimed at enhancing effective judicial protection within SSM composite procedures. Show less

Wat kan de rechter doen als hij hen gelijk geeft? Over wat voor gereedschap beschikt de Nederlandse rechter? En gebeurt het ook weleens dat de rechter helemaal niets doet? Die vragen staan centraal in dit boek. Het geeft een uitgebreid overzicht van de constitutionele remedies in de gereedschapskist van de rechter. Show moreAdequate and fair asylum procedures are a precondition for the effective exercise of rights granted to asylum applicants, in particular the right not be expelled to a country where they face the risk of being subjected to human rights violations. In 1999 the EU Member States decided to work towards a Common European Asylum System. In this context the Procedures Directive was adopted in 2005. This directive provides for important procedural guarantees for asylum applicants, but also leaves much discretion to the EU Member States to design their asylum procedures. An important result of the adoption of the Procedures Directive is that asylum procedures now fall within the reach of the Charter and general principles of EU law. This book examines the meaning of the EU right to an effective remedy for the legality and the interpretation of the Procedures Directive. For this purpose the EU Courts' case-law on the EU right to an effective remedy is examined. The interpretation of the EU right to an effective remedy is inspired by international law. Therefore this book also extensively discusses the ECtHR's case-law as well as the views of the UNHCR and UN Committees concerning procedural rights for asylum applicants. The result of this exercise is a set of procedural standards with regard to several key issues of asylum procedures: the right to remain on the territory of the Member State, the right to be heard, the standard and burden of proof and evidentiary assessment, judicial review of the establishment and qualification of the facts and the use of secret evidence. Show moreConstitutionalism is the permanent quest to control state power, of which the judicial review of legislation is a prime example. Although the judicial review of legislation is increasingly common in modern societies, it is not a finished project. This device still raises questions as to whether judicial review is justified, and how it may be structured. Yet, judicial review’s justification and its scope are seldom addressed in the same study, thereby making for an inconvenient divorce of these two related avenues of study. To narrow the divide, the object of this work is quite straightforward. Namely, is the idea of judicial review defensible, and what influences its design and scope? This work addresses these matters by comparing the judicial review of legislation in the United Kingdom (the Human Rights Act of 1998), the Netherlands (the Halsema Proposal of 2002) and the Constitution of South Africa of 1996. Show moreDit onderzoek gaat over de toetsing door de rechter van milieubesluiten, bijvoorbeeld een besluit van de gemeente tot het verlenen van een milieuvergunning voor een voetbalstadion. Tegen een dergelijk besluit kunnen belanghebbenden beroep aantekenen bij de Afdeling bestuursrechtspraak van de Raad van State. Deze rechter kan bepalen dat de vergunning in stand blijft, maar kan deze ook vernietigen, bijvoorbeeld omdat onvoldoende onderzoek naar de gevolgen voor de luchtkwaliteit is gedaan. Bij een dergelijke uitspraak wordt nogal eens de vraag gesteld of de rechter wel voldoende ruimte aan de gemeente laat om tot een eigen oordeel of afweging te komen. Het gaat hierbij om de vraag hoe indringend de rechter een overheidsbesluit moet toetsen. Ter beantwoording van deze vraag bespreek ik de verhouding tussen wetgever, bestuur en rechter, zowel meer in het algemeen als specifiek in het milieurecht. Daartoe analyseer ik het toetsingskader van de Wet milieubeheer en bezie ik kritisch de rol van de in de praktijk zeer belangrijke pseudo-wettelijke milieurichtlijnen. Mede op grond van een empirisch onderzoek naar 200 uitspraken concludeer ik dat de Afdeling in lang niet alle gevallen een juiste toetsingsmaatstaf aanlegt. Het voorgaande gaat over de verhouding tussen de rechter en het bestuur (als vergunningverlener). Een tweede belangrijk onderdeel van mijn onderzoek betreft de verhouding tussen rechter en deskundige. Omdat in milieugeschillen vaak technische vragen spelen, wint de rechter in veel gevallen advies in bij een deskundige. Hierbij rijst de vraag hoe de rechter bij zijn streven het geschil inhoudelijk te beslissen, kan voorkomen dat hij blind vaart op het deskundigenrapport. Ter beantwoording van deze vraag beschrijf ik zowel het theoretisch kader als de praktijk van de deskundigenadvisering in milieugeschillen, mede in het licht van artikel 6 EVRM (eerlijk proces). Op dit punt concludeer ik onder meer dat, uit het oogpunt van hoor en wederhoor, het deskundigenrapport eerst in concept aan partijen zou moeten worden voorgelegd, voordat de deskundige het naar de rechter stuurt. Een andere conclusie is dat de rechter duidelijker moet aangeven op welke passage(s) van het deskundigenbericht hij zijn oordeel baseert. Show less
