Show moreThis study ("Intellectual property in the conflict of laws") deals with the fundamental question whether the two most important intellectual property treaties, i.e. the Berne Convention 1886 and the Paris Convention 1883, contain a conflict-of-law rule. The study reveals that the principle of national treatment in these treaties does indeed contain a conflict-of-law rule. The explanation given for this seems to be new. It provides a comprehensive and consistent interpretation of the respective provisions in the treaties, and it explains why we no longer understand this conflict-of-law rule today. The study provides, in addition, several new insights into the conflict of laws, aliens law, and the relationship between these two fields of law. Show less

Show moreThe object of the study concerns the assessment of non-pecuniary damages (pain and suffering). Non-pecuniary damage cannot be computed in any way whatsoever. The law meanwhile demands rulings on non-pecuniary damages to be consistent although no two cases are (entirely) the same. The author would prefer a court faced with the issue of the extent of the actual non-pecuniary damage to focus on the amounts in non-pecuniary damage laid down in a Judge-made regulation, the product of judicial cooperation or coordination. The author understands coordination to mean any activity geared towards harmonizing the judicial and/or extrajudicial determination of non-pecuniary damages. A judge-made regulation could avert the risk of incoherence between court rulings and inefficiency. A risk that lies both in the inherent arbitrariness attached to the translation of non-pecuniary damage into financial compensation for such damage, and in the related risk of arbitrariness that is imminent as the legislator the Supreme Court and the Courts of Appeal give few directions about the desirable amounts and method of determination of non-pecuniary damages by other courts. In welke gevallen is hantering op zijn plaats en waar of hoe dient de rechtsvinder de inhoud van de verkeersopvatting te achterhalen? Een overkoepelende studie naar het begrip verkeersopvatting en de daarbij behorende rechtsvindingsmethoden ontbrak tot op heden. Dat geldt niet alleen voor Nederland, maar ook voor het buitenland, waar een verwijzing naar de verkeersopvatting in bepalingen van het burgerlijk wetboek niet voorkomt. Dit proefschrift schetst een theoretisch kader voor het begrip verkeersopvatting. De auteur laat haar licht schijnen over de volgende vragen. Is hantering van de verkeersopvatting noodzakelijk en wat zijn de nadelen van haar hantering? Verwijst het begrip naar feiten of naar ongeschreven recht? Wat zijn de kenmerken van verkeersopvattingen? Hoe verhoudt het begrip zich tot aanverwante begrippen? Wat zijn de functies van de verkeersopvatting? Nadat de theoretische achtergronden van het begrip in kaart zijn gebracht, reikt de auteur enige handvatten voor de rechtspraktijk. Het boek biedt praktijkjuristen houvast bij de concretisering van de verkeersopvatting en de auteur doet ten behoeve van de rechterlijke macht aanbevelingen voor de motivering van beslissingen aan de hand van de verkeersopvatting.
