Een burger die een omgevingsvergunning heeft gekregen voor een schuur, kan ermee worden geconfronteerd dat hij die schuur niet kan bouwen zonder onrechtmatig te handelen jegens zijn buurman. Dit is lastig uit te leggen. Maar hoe gaat een rechter om met een uitspraak van een collega-rechter? Nederland kent vijf hoogste rechterlijke instanties. Daarnaast spelen arresten van het HvJEU en het EHRM een grote rol. Tussen deze instanties bestaat geen hiërarchische relatie. Ondanks dat deze instanties beschikken over een als exclusief bedoelde bevoegdheid, komt het ook regelmatig voor dat meerdere hoogste rechterlijke instanties zich bevoegd achten. In dit proefschrift wordt de verhouding tussen hoogste rechterlijke instanties besproken waarbij een bestuursrechter betrokken is. Hoe komt het dat meerdere rechterlijke instanties bevoegd zijn hetzelfde geschil te beoordelen en wat zou een rechter met uitspraken van andere rechters moeten doen? Komen deze instanties tot dezelfde oordelen over de verbindendheid en interpretatie van algemeen verbindende voorschriften en de vaststelling van feiten? Er wordt aandacht besteed aan de vraag of in verschillende in het zeevervoer veelvoorkomende situaties een forumkeuze tot stand komt. Vertrekpunt voor de beoordeling is regelmatig een bepaalde praktijksituatie. Omdat bij vervoerovereenkomsten, anders dan bij de meeste overeenkomsten, in de regel een derde (bijvoorbeeld een derde-cognossementhouder) op een later moment op een of andere manier partij wordt bij de vervoerovereenkomst, wordt ook ingegaan op de vraag in hoeverre deze derde uiteindelijk gebonden is aan de forumkeuze. De meeste aandacht gaat uit naar de forumkeuze in de zin van art. 23 EEX-Vo/art. 25 EEX-Vo (nieuw). Show moreThe subject of this thesis is the administrative relation between the levels of authority in the Netherlands. Focus of attention within this study is the distribution of administrative tasks and legislative power between government tiers. And more particular the way it has developed since the constitutional reform in 1848; what motives have underpinned the fluctuating ways in which responsibilities and powers were divided. The constitutional reform of 1848 has laid the foundation for the current administrative structure. A three tiers-system forms the basis of its organisation. Decentralization, the transfer of functions and powers of the national government to the provinces and municipalities, gives meaning to the administrative stratification. This study shows that in The Netherlands the leitmotiv for decentralization is to improve the governmental performance; efficiency, standardization and simplification are recurring objectives. Decentralization is also often used as an instrument to resolve specific policy issues. A third motive for decentralisation is improvement of the administration and organisation of government. This study shows there is little debate about the underlying motives for decentralization. In some occasions articles of (constitutional) law are changed without any parliamentary debate whatsoever. Even if debate takes place, justifications are often unfounded or accompanied by defective reasoning. Show less

Show moreApproximately 2.5% of the electorate in the Netherlands is member of a political party. This modestly sized group plays an important role in representative democracies: members are part of the electorate and of their party and function as intermediaries between voters and elected officials. There is, however, debate as to the role of party members. The impression exists that members of the same party are internally divided over important political issues, that it is largely impossible to distinguish between members of different parties substantively, and that members differ in terms of views and backgrounds, and thereby drive a wedge between voters and elected officials. Based on the Leyden Party Member Survey, this study investigates how internally cohesive, externally different and representative in terms of membership Dutch parties are. This study's findings suggest, at least for the Netherlands, that the view that party members are obstacles is factually incorrect. In general, party members are internally quite cohesive and adopt a shared, substantive position that differentiates from the position of members of other parties. Although their demographic profile deviates, members' substantive views are congruent with those of the voters and MPs of their party. Show less

Show moreMy research is based on transculturalism in the works of Iranian authors living in France since the 1980’s. Referring to the cultural interbreeding, transculturalism constitutes a field of research, which is becoming increasingly important in numerous countries. In literature this concept concerns hybrid works, i.e. works emanating from two or more different cultures. In French-Persian creations it shows the mixture between a Western tradition of novel and the dominating place of lyricism and poetry in the Eastern writing. It may open also to an interesting course of reflection in the cultural and social domain of multiculturalism and transculturalism more in general. It aims at current issues seen from a double perspective: the interdependency of the different cultures and a new type of literature from the perspective of writing. Those creations are intermediary between the artist in exile and the receiving society. They transmit values of interculturalism, permitting interaction between cultures. But also represent transculturalism, which transcends the simple ‘dialogue’ between two cultures to reach an original synthesis. My goal was to search hybrid factors in these works and to see how they are carried out concretely in the texts. Then we see who these works might be qualified as transcultural. Show less

Show moreMy dissertation provides a detailed description of the interaction between verb semantics and the two grammatical voice categories (that is, middle and active voice) in the Vedic Sanskrit of the Rigveda (which is the earliest text of the Old-Indic religious tradition, datable to plus/minus 1500 BC). I give a full synchronic description of the middle voice semantic cluster (including a list of all middle readings) and the verbal lexicon with regard to valency and semantic transitivity. In addition, the two last chapters are devoted to paradigmatic voice marking asymmetries found in the text which point to a particular prehistory of its voice system. Show less

Critical conscripts, conscientious objectors, professional soldiers, civilians and antimilitarists posed these questions during the Cold War. This study investigates their criticism of and protest against the armed forces and national security and defense policy in the Netherlands between 1945 and 1989. It first examines how and why the critics of the armed forces questioned its form and existence. Secondly, this study looks into the Ministry of Defense's reaction to these critics. It explores how the ministry interpreted and responded to criticism and protest. The main question of this study is to what extent did the ministry believe that the criticism undermined the armed forces' legitimacy? Show less

His background, appointment, work, earnings and importance for the Dutch navy are the central topics. This non-commissioned officer occupied an important position both on board and on shore. Indeed, he was a key figure in many respects. It is this figure who forms the focus of this study, considered within the context of the warship as a seafaring enterprise. Show less

Show moreThe performance practice of Italian instrumental music in relation to vocal music and text: Sources and their modern realization. In my work I have shown that in the second half of the 18th century in Italy, one prepared instrumental music for performance with the help of texts. Central to this work is a treatise by Benvenuto Robbio Conte di San Raffaele stemming from the circle around Giuseppe Tartini which demonstrates the various steps of learning instrumental music through text underlay. Based on this, I could show how in various genres (solfeggi, recitatives, arias) numerous composers (Domenico Corri, Francesco Geminiani, Guiseppe Tartini) used texts and singing in preparing instrumental music for performance. The influence of this sort of “vocal” preparation on the interpretation of instrumental music has proved itself to be very fruitful in my own playing as well as in my work with students. Show less

De taal stond een snelle verspreiding van de tekst niet in de weg. Herps Spieghel werd een ongekend internationaal succes. In Literatuur en observantie beschrijft Anna Dlabacová dit succes, dat zich afspeelt tegen de achtergrond van een brede religieuze vernieuwing in middeleeuws Europa. De lezer maakt kennis met een wereld waarin het strenge observantie-ideaal hand in hand ging met de verspreiding van nieuwe teksten onder religieuzen en leken. Persoonlijke contacten en netwerken van kloosters, drukkers en leken zorgden ervoor dat de verspreiding van literatuur een nieuwe impuls kreeg. Show moreBunkeya et ses chefs provides a history of town of Bunkeya, a traditional centre of rule in Katanga, the south-easterly province of the Democratic Republic of Congo. Primarily, it tells the history of the Yeke chiefs, the first of whom, Msiri, founded a kingdom based on slave exports and the control of firearms. In 1891 Msiri was assassinated by the Belgian colonisers, and his capital was abandoned. However, his successors established good relations with the Belgians, and from 1910 returned to Bunkeya, which became a regional centre, with schools, missions and a flourishing commerce. On the basis of the education they received, the successors of Msiri, above all the brothers Antoine and Godefroid Munongo, became major political figures in the region. In particular Godefroid was a leading politician, advocating Katangese succession. In the turbulent times after the independence of Congo, Godefroid was i.a. heavily involved in the murder of Patrice Lumumba, and the government of Moise Tshombe, but nevertheless managed to survive, and to became a leading lieutenant of the dictator Mobuto. Godeforid was able to use the power he so accrued to greatly improve the economic position of Bunkeya, so that it is now a flourishing commercial town. Show less

Daarin worden drie fasen onderscheiden: de aanloop naar het vrijmetselaar worden, het moment dat hij vrijmetselaar wordt en de tijd dat hij vrijmetselaar is. Gehoopt wordt dat, op basis van de onderzoeksresultaten, meer zicht gekregen wordt op de eerder genoemde ontwikkelingen in het religieuze domein. This is corroborated both by ancient literature and the frequency and accuracy of the depictions of the military belt on the gravestones of the soldiers. The immense ideological value invested in the belt originated in its function as sword belt, but then developed independently from it. This comprehensive study of the Roman military belt combines the written sources with the pictorial representations of belts and the archaeological finds of the metal mounts, buckles and hangers of the belt. In addition to discussing typological features and analysing the distribution and dating of the different types, questions on the social significance of this distinct piece of equipment are discussed. The book aims to give as broad a picture as possible of the Roman military belt; from its origins and development to its visual, acoustic and physical characteristics and from its ideological value to its influence on the everyday posture of the Roman soldier. Show moreThis study focuses on the use of witness testimony in Dutch criminal procedure and looks at whether the existing framework for criminal procedure and modes of operation in criminal legal practice require adaptation in light of truth-finding. Determining the credibility of witness testimony in a criminal legal context is to an important extent, steered by factors about which non-legal disciplines can provide more insight. This study maps and connects the different insights. The collected insights subsequently offer a framework to further review the statutory procedures and modes of operation in practice with regards to the production and assessment of witness testimony. Because of the strong accentuation of written documents Dutch criminal justice is under suspicion of not having the right instruments at its disposal to optimally test the content of testimony and therewith adequately guarantee the quality of criminal legal truth-finding. This study shows that in practice, there are a number of weaknesses in the manner in which witness testimony is handled and that the judicial decision in this regard is a risky decision. Besides the fact that the aspect of production remains underexposed in the process of assessment, it may be established that the judge hardly has any purchase in statutory law or legal doctrine for the assessment of witness testimony. Recommendations are made to adapt Dutch legal procedure and some practical modes of operation. Show less

Dat waren er drie: - De vier burgemeesters vormden het dagelijks bestuur: zij beslisten over alle uitgaven van de stad, deden veel benoemingen en onderhielden contacten met bijvoorbeeld andere steden en het landsbestuur. - Het college van schout, burgemeesters en schepenen, oftewel de heren van de wet, stelde de wetten en regels vast in Delft, en besloot ook over de toepassing ervan. Grofweg de helft van de onderwerpen die bij de heren van de wet ter tafel kwamen, waren aangedragen door de stadsbewoners in de vorm verzoekschriften. - De veertigraad bemoeide zich vooral met het bestuur van heel Holland; de stad had daarin ook daadwerkelijk een stem. Daarnaast had de raad een belangrijke rol bij de jaarlijkse verkiezing van de heren van de wet, evenals van andere bestuurders. Vaak deden de Delftse stadsbestuurders onderzoek voordat zij een besluit namen. Zij informeerden bij betrokkenen, onderzochten hoe hun voorgangers in vergelijkbare gevallen hadden besloten of welke regels andere steden op hetzelfde punt hadden ingesteld. Show moreNews media and web-based discussion forums frequently feature crime stories so monstrous that they defy belief and are classified as crime legends. The present study focuses on the rhetorical means employed by journalists and forum users to convince their audience of the veracity and value – or the lack thereof – of these recur¬rent stories about horrendous crimes. Two cases were studied: stories featuring the motif Drugged and Abused (1885-2008) and the tale type of the Smiley Gang (2003). It is argued that approaching crime legends as rhetorical constructions instead of essentially untrue stories opens new windows for the analysis of both news and vernacular discourse and as a point of departure for critiquing journalistic practices Show less
