This report is in part based on the author's comparative analysis of the LawsAndFamilies Database (www.LawsAndFamilies.eu) in his 2017 report More and more together: Legal family formats for same-sex and different-sex couples in European countries.The report notes clear and rapid trends, among a large majority of the 21 European countries surveyed, of offering same-sex couples the opportunity to formalise their relationship as marriage and/or as registered partnership, and of attaching more and more rights and responsibilities to the cohabitation, the registered partnership and/or the marriage of two people of the same sex. It concludes that the consensus among these countries is particularly strong as regards:

  • legal protections for times of death (such as: tenancy continuation, wrongful death compensation, inheritance, inheritance tax exemption, survivor’s pension);
  • legal protections for times of other great sadness (such as: next of kin provisions, protection against domestic violence, leave from work in case your partner or your partner’s parent is in need of care);
  • the right to come and live in the same country as your partner;
  • the possibility to take (at least some) responsibility for your partner’s children.

The high levels of consensus on these particular issues, may assist the European Court of Human Rights in narrowing the freedom that countries have had in deciding what rights and responsibilities to make available to same-sex couples.The report was written for the Council of Europe (at the initiative of its Sexual Orientation and Gender Identity Unit) for a conference (Copenhagen, 2 March 2018) on equal opportunities and rights in private and family life for lesbian, gay, bisexuals, transgender and intersex people. That conference was co-organised by the Danish Chairmanship of the Committee of Ministers of the Council of Europe, the Danish Parliament, and the Committee on Equality and Non-Discrimination of the Parliamentary Assembly of the Council of Europe. The latter Committee, in September 2018, referred to this report in its own report Private and family life: achieving equality regardless of sexual orientation, which on 10 October 2018 led to the adoption by the Parliamentary Assembly on of Resolution 2239(2018).

Vela, Kees Waaldijk, and Giuseppe Zago.This report offers a comparative analysis of legal and other data concerning same-sex (and different-sex) families, in marriage, in registered partnership, and in cohabitation. These data (from a legal survey among legal experts in 21 European countries, from sociological interviews with same-sex families in four European countries, and from a statistical survey of twelve European countries) have been brought together in the LawsAndFamilies Database – Aspects of legal family formats for same-sex and different-sex couples (www.LawsAndFamilies.eu). The report presents the database and the methodology of the legal survey, followed by an overview and analysis of the main results of that survey for the different countries in light of European minimum standards, plus five comparative cases studies on specific legal issues for which the database now provides detailed information, and a synthesis of the findings from the qualitative interviews. The conclusion highlights the main findings on the situation of same-sex couples, including gender aspects, and offers recommendations for further research and for legal policy; it connects legal and sociological findings, and presents correlations between laws, public attitudes, and statistics. Show moreWhile it has become common knowledge that in many parts of Africa — including Botswana — weddings and marital arrangements in general have increasingly become subject to consumerist desires of style and glamour, much less is known about how such expectations of public display intersect with changing ideas concerning the intimate. Weddings have not only become costlier than before, and much more crucial in the marking of class, status and prestige, they have also given way to shifts in the responsibilities concerning marital arrangements, in the provisioning of resources and in the taking charge of the glamorous styling of these events. Studying such marital arrangements in Molepolole, Botswana, reveals that these shifts are creating a new sense of joint responsibility among young couples in terms of their role in providing such (re)sources. They are also producing a new dimension in their formation of relational intimacies; that is, making their financial affairs part of the intimacy of their relationship not meant for scrutiny and inspection by family elders. Engaging an anthropological understanding of the ways in which money can be related to intimacies, this contribution aims to understand how taking responsibility for finances becomes an intimate matter in the wedding process. Show moreMarriage used to be widespread and common throughout Southern Africa. However, over the past decades marriage rates have substantially declined in the whole region. Marriage has changed from a universal rite of passage into a conspicuous celebration of middle class lifestyles. Bridewealth or lobola remains important and is supplemented by a plethora of new rituals and expenditures. Yet, despite marriage's recent turn towards exclusivity, the institution nevertheless continues to be an important frame of reference for most people. The contributions in this special issue explore reconfigurations of marriages and weddings in South Africa, Botswana and Namibia through the last decades. While there are numerous anthropological studies on marriage in Southern Africa for the period up to the 1980s, a remarkable paucity of studies has to be noted for the time since then. The ethnographic and comparative findings on Southern African weddings and marriages compiled in this special issue pick up an important anthropological legacy and stimulate future research and theorising. Show moreThis Working Paper of the research project FamiliesAndSocieties contains the text of the LawsAndFamilies questionnaire, plus the text of the guidance document provided to legal experts answering this questionnaire. These texts are preceded by a brief introduction to the background, aims and development of this questionnaire on legal family formats for same-sex and/or different-sex couples. The majority of questions ask if – in the jurisdiction of the legal expert concerned – a specific legal consequence is attached or not to (same-sex and/or different-sex) marriage, registered partnership and/or cohabitation. And it asks since when this is so. The questions are about legal aspects of formalisation, income and troubles, parenting, migration, splitting up and death. The questionnaire is used to create The LawsAndFamilies Database – Aspects of legal family formats for same-sex and different-sex couples, www.LawsAndFamilies.eu, where from early 2017 the answers to the questionnaire provide an overview of the legal situation in more than 20 European countries. Show moreThis paper attempts to clarify the trend in the inverse relationship in increasing age at first marriage and simultaneously declining fertility rates generally in Ghana, using examples of two coastal Ghanaian communities - Brenu Akyinim (Central region) and Abuesi (Western region). Two sets of data used for this study include empirical data derived from the first round of the Diffusion of Fertility Behaviour Survey; and the second set of data is obtained from Focus Group Discussion (FGDs) conducted on four groups randomly selected from current cohorts of panel survey respondents homogenous by age and sex. Data analysis shows that changes in fertility rates are socially embedded; the mechanisms through which these occur are identified. The paper further provides an understanding of how the socio-economic power play in gender relations leads to particular fertility rate outcomes between the two villages. Of essence here is the role of marriage and stable unions. Our data further shows that there are significant differences in reproductive behaviour between the two villages, and it appears that economic activity bears the closest relationship to the differences observed. Show moreWe investigate whether the set of available enforcement mechanisms affects the formation of risk sharing relations by applying dyadic regression analysis to data from a specifically designed behavioural experiment, two surveys and a genealogical mapping exercise. During the experiment participants are invited to form risk sharing relations under three institutional environments, each associated with different enforcement mechanisms: external, intrinsic and endogenous extrinsic, i.e., the threat of (partial) social exclusion. Dyads who are similar in age and gender, genetically related, or who belong to the same organizations with an economic purpose are more likely to share risk. However, the latter are associated with less risk sharing when endogenous extrinsic incentives can be applied, while co-membership in religious congregations and being related by marriage support enforcement through such incentives. We find no evidence of assortative grouping on risk preferences but, ex post, co-groups members' risk-taking behavior converges. Show less
