Show moreMaritime conflict management is the regulation of conflict in relation to the sea. It comprises conflict enforcement, conflict resolution and conflict avoidance. How did victims of maritime conflicts claim and obtain damages or demand compensation or reparation? The articles in this issue aim to shed light on this question from two distinct yet related perspectives: that of the aggressor and the victim, on the one hand, and that of the political entities to which they belonged, on the other. The articles, covering seven centuries, reveal connections and entanglements between private parties and public authorities, demonstrating the importance of both for the development of maritime conflict management. Taken together these contributions provide evidence for the gradual development of maritime conflict management, diplomacy and norms for international law. Show less

Show moreThis article discusses how merchants or skippers suffering losses aimed to get redress for damages in trading and shipping from or with Holland and Zeeland in the fourteenth and early fifteenth century within the context of Anglo– Dutch trade and diplomacy. In accordance with legal doctrine both the English king and the Count of Holland considered reprisal as an ultimate remedy. Both rulers used the possibility of reprisal as a means of pressure within Anglo–Dutch diplomacy. Their willingness to support their subjects went beyond the issue of damage redress as it also enabled them to have more control over their subjects. When reprisal was eventually issued, rulers on both sides of the Channel carefully supervised and controlled its procedures. Even though rulers were prepared to support victims via diplomacy and, ultimately, reprisal, they did consider individual interests in the functioning of the wider political and economic interests of their countries. Show morePastoralist societies in Africa are claimed to be prone to violence due to structural conditions of environmental vulnerability, scarcity of resources and decentralized sociopolitical organization. Their contacts with expanding State structures and with neighbouring groups in different socioeconomic conditions are seen to add to instability, due to the underlying hegemonic project of national States, while major economic and demographic changes also play a role. This paper presents a comparative overview of factors that come into play in the 'production of conflict' in and between pastoral societies, focusing on Northeast Africa. It contends that while conflict was a regular feature of life in traditional pastoral societies, its nature and frequency have significantly changed in the confrontation with State forces, whereby unresolved tensions between traditional and 'modern' judicial conflict regulation mechanisms play a role. External agencies approach these pastoral societies in conflict without paying proper attention to the larger political-economic context in which they operate and which constrains them in a political and ideological sense. A number of case studies reveal that structural instability in contemporary pastoral societies is usually not properly interpreted by outside agencies and not easily 'resolved'. Hij begint met de voorwaarden voor en kenmerken van verzoening en de betekenis van de tijdsdimensie daarin. Daarna beschrijft hij de problematiek van verzoening en conflict in segmentaire, hoofdloze samenlevingen en van verzoening en recht in meer gecentraliseerde samenlevingen. Tenslotte vestigt hij de aandacht op de rol van ritueel en therapie. Hij betoogt, dat Afrikaanse samenlevingen buitengewoon effectieve middelen hebben ontwikkeld, in de juridische, therapeutische en rituele sfeer, om verzoening voor te bereiden en tot stand te brengen. Grenzen aan verzoening worden gevormd door hekserij, het tegendeel van verzoening, en het feit dat verzoening wel adequaat is voor het beheersen van conflicten op het niveau van de dorpssamenleving, maar niet op regionaal, nationaal en internationaal niveau.
