Show moreOpportunities for negotiation in formative assessment may benefit teachers' professional development. Detailed analysis of nine assessment dialogues involving pairs of nursing teachers in secondary vocational education showed that the amount of negotiation was limited. Assessment dialogues provided ample opportunities for negotiation (based on expressed disagreement), but more than half of these opportunities were neglected and hence not used to negotiate learning implications. Participants found it difficult to confront a colleague. Possible reasons for this, also methodological, are discussed with a view to future training, formative assessment and research. Show less

Show moreDiplomatiek onderhandelen is een moeilijk te begrijpen en te beheersen proces. Toch is het onderhandelen tussen staten en in internationale organisaties van levensbelang voor het functioneren van het internationale bestel. Het Handvest van de Verenigde Naties noemt onderhandelen dan ook als het eerste instrument bij het vreedzaam oplossen van conflicten. De wetenschap is nog altijd op zoek naar methoden om de uitkomst van een onderhandeling te verklaren uit de processen waaruit zij is voortgekomen. Dit proefschrift benadert het diplomatiek onderhandelingsproces van verschillende kanten en tracht daarmee aan de hand van gevalstudies in verleden en heden de essentie en de evolutie van het proces beter in beeld te krijgen. Een goed begrip daarvan zal, zo wordt gehoopt, bijdragen tot een effectiever gebruik van het diplomatieke geven en nemen, om daarmee geweldsgebruik terug te dringen. Dat neemt niet weg dat onderhandelen een belangenstrijd blijft, het is een vorm van oorlog met vreedzame middelen. Kernpunt van dit boek is de stelling dat onderhandelen tussen staten pas een werkelijk alternatief voor oorlogvoering kan zijn, als het kan worden gevoerd binnen een kader van regels en procedures om het onderhandelingsproces in goede banen te leiden en gebrek aan vertrouwen tussen partijen te verminderen. Daarin ligt het belang van internationale regimes die de concrete vorm kunnen aannemen van internationale organisaties, met de potentie de uitvoering van genomen besluiten af te dwingen. Uit de voortdurende pogingen de internationale betrekkingen beter te organiseren blijkt dat de diplomatie allang tot dit inzicht is gekomen. Het blijkt echter al even duidelijk uit het falen van onderhandelingen als middel tot conflictbeheersing in gebieden waar een overkoepelende onderhandelingsstructuur ontbreekt, zoals nu in het Midden-Oosten. Diplomatic Negotiation is difficult to grasp, both in practice and in theory. Yet it is important to get to grips with this process, as negotiations between states and in international organizations are the lifeblood of the international body politic. The Charter of the United Nations, for obvious reasons, ranks negotiation as the foremost instrument in the peaceful settlement of inter-state conflicts. Scholars of international relations, however, are still searching for methodologies and theories to explain the outcomes of negotiations by the processes that produce them. This doctoral dissertation approaches the process of diplomatic negotiation from different angles, while applying a multi-faceted qualitative analysis of case studies from the past and present. It is hoped that a better understanding of negotiation as one of the main tools of diplomacy will help to enhance the effectiveness of this process as an alternative to warfare. Still, negotiation is basically a struggle in the promotion and defence of state interests. It is war by peaceful means. The central proposition of this book is that negotiations between states can only be a viable replacement of the use of violence if they are conducted within a framework of international regimes that set the rules and procedures for negotiation behaviour and mitigate lack of trust. International regimes may take the shape of international organizations, which can force countries to live up to their agreements. Diplomats and political leaders have come to recognize this, as the evolution of diplomacy in the last 400 years testifies. Diplomatic negotiation may be taken as a ceaseless series of attempts to bring more order to the international system. The current demise of the negotiation processes in the Middle East thus demonstrates the failure of the international community to build overarching negotiation structures. Show less

Show moreThe literature indicates that teacher professional development and learning may be improved by using formative assessment procedures. This thesis focuses on a specific form of formative assessment, negotiated assessment, which is characterised by the exchange of views between assessor and assessee and the extensive involvement of the participants (assessees) in their own assessment procedure. The participants negotiate with their assessor about several aspects of the negotiated assessment procedure. Assumptions in negotiated teacher assessment are that the opportunities for negotiation might promote the development of a sense of agency in terms of teachers feeling in control of their learning and assessment processes and feeling able to pursue their learning objectives. This thesis covers four studies in which different aspects of negotiated assessment were examined. Its aim was to gain more knowledge about a negotiated assessment procedure to promote teacher learning in the area of stimulating students__ reflections. The results show that very little negotiation took place during the dialogues. Despite the lack of negotiation during the assessment meetings, the teachers reported a strong sense of agency. Overall, the teachers__ opinions indicated that the elements of the negotiated assessment procedure facilitated their professional learning. The contribution was particularly seen in change in their knowledge, beliefs, attitudes and practice. Show moreDeception is often described as a form of unethical behavior, yet it is frequently used in bargaining. This raises the question why people use deception in bargaining. In this dissertation an instrumental approach to deception is presented to help answer this question. In an instrumental approach, the use of deception depends on both the goals bargainers pursue and the means they have to attain their goals. An instrumental approach presupposes that bargainers select the means they consider most instrumental to their current goal. This dissertation demonstrates that pursuing different goals or having different means, has an impact on the use of deception. Furthermore, it demonstrates that reactions to deceit also follow an instrumental pattern. Deceit was judged less harshly when it was employed by someone in a position with limited means. Finally, this dissertation shows that false expectations are an important reason why deception is considered unethical. Show less

Show moreIn het proefschrift wordt aan de orde gesteld in hoeverre de sollicitatiefase en de proeftijd door het recht worden genormeerd. Daarnaast wordt de vraag gesteld of de bescherming van de sollicitant respectievelijk werknemer in de proeftijd in verhouding tot het belang van de werkgever voldoende is en of verdere normering (al dan niet via een wettelijke regeling) is aangewezen. Voor de sollicitatiefase en regeling van de proeftijd wordt in het boek een vergelijking gemaakt met het Duitse rechtssysteem. Er bestaat reeds een NVP Sollicitatiecode. Gebleken is evenwel dat deze bij ondernemingen en instellingen onvoldoende bekend is. Wetgeving voor de werving en selectie zal dan ook eerst meerwaarde hebben als de sollicitatiecode bij de werkgever en sollicitanten voldoende bekend is geworden en in de wet een goed werkend sanctieapparaat is opgenomen. In haar algemeenheid is de rechtspositie van de sollicitant naar Duits recht niet wezenlijk beter of slechter dan de rechtspositie van de sollicitant naar Nederlands recht. De Duitse sollicitatieprocedure onderscheidt zich in positieve zin van de Nederlandse sollicitatieprocedure door de duidelijke informatie-uitwisseling middels de uitgebreide documentatie die op grond van het gebruik bij een sollicitatiebrief wordt gevoegd. In het proefschrift is een proeve voor een nieuwe proeftijdregeling opgenomen. Voor de totstandkoming van deze proeve is gekozen voor een combinatie van het Duitse en Nederlandse rechtssysteem. In de proeve heeft Kötter de voordelen van de proeftijd naar Duits recht, zoals de plicht tot feitelijke proefneming, het hanteren van een opzegtermijn bij opzegging van de arbeidsovereenkomst tijdens de proeftijd en het hanteren van een langere maximumduur (zes maanden) van de proeftijd in het belang van de feitelijke proefneming overgenomen. Voordelen van de huidige Nederlandse proeftijdregeling zijn in de proeve intact gelaten. Show less
