Show moreThe case note addresses three judgments the Grand Chamber of the Court of Justice of the EU handed down on the same day, all relating to Italian prejudicial questions concerning the principle of ne bis in idem. These are the first cases addressing questions of 'bis' and the duplication of criminal and administrative sanctions for financial offences since the Grand Chamber of the European Court of Human Rights revised its case-law in A and B v. Norway (2017). The case note addresses to what extent the Court of Justice follows the ECtHR's approach, where how and why their respective approaches diverge, and finally affords some attention to the judicial dialogue between the Courts in Luxembourg and Strasbourg.
