Show moreThis book focuses on the general right of suspension regulated in article 6:52 et seq. of the Dutch Civil Code. The author pays attention, among other things, to the requirements for the power to suspend, including the coherence criterion (Dutch: samenhangcriterium), which is also the central requirement. The author explains that this criterion is not a measure of judgment or criterion to be judged by itself, but the existence of sufficient coherence between mutual obligations to justify suspension is rather a conclusion that follows the application of the coherence criterion. The author also discusses how the general right of suspension is exercised. Under circumstances, that exercise may be unacceptable. This involves weighing the interests involved in that exercise. Procedural aspects of the general right of suspension are also discussed, including the dictum. The author discusses that under circumstances an order for gradual performance fits a defense of suspension better than a rejection of the claim. The author makes this concrete using many examples mainly from case law. This book is therefore relevant for both law and legal practice. Show less

Show moreIn dit onderzoek staat de vraag centraal wat het beginsel inhoudt, dat niemand ten koste van een ander ongerechtvaardigd mag worden verrijkt en hoe dit beginsel tot uitdrukking komt in het systeem van het vermogensrecht. Betoogd wordt dat het verrijkingsbeginsel in verschillende vermogensrechtelijke regels tot zijn recht komt en dat de algemene verrijkingsactie vooral een aanvullende functie heeft om onvoorziene verrijkingsgevallen tot een oplossing te brengen. Een belangrijk deel van het onderzoek draait om de vraag wat de aanvullende functie met zich brengt voor de invulling van de toepassingsvereisten van de algemene verrijkingsactie. Een belangrijke bevinding is dat de figuur van de ongerechtvaardigde verrijking niet teveel a priori moet worden beknot. Zo wordt betoogd dat aansprakelijkheid op grond van ongerechtvaardigde verrijking onder omstandigheden een alternatief kan bieden als aansprakelijkheid op grond van overeenkomst of onrechtmatige daad niet haalbaar of twijfelachtig is. Show moreIn this dissertation the agreement as to proceedings is the central point. By means of an agreement as to proceedings, parties diverge from procedural law. It is relevant to conduct research into agreements as to proceedings, as they may contribute to a swift and efficient course of the civil proceedings. In addition, research into these agreements can result in a better insight into the question about the control over the proceedings. Who ultimately has the right to determine the course of affairs during the proceedings? Is it the parties, whose substantive rights are at issue, or is it the government, which makes the civil proceedings available? Three main questions are to be distinguished in this research. Firstly, the admissibility of agreements as to proceedings has been examined. To what extent can parties validly conclude an agreement as to proceedings? Secondly, the effect of agreements as to proceedings has been examined. What are the consequences of an agreement as to proceedings concluded by parties? Show moreThis book ('The reliance principle and contractual liability: an inquiry into the dogmatics of contract law') aims to be a contribution to the field of civil law and legal theory. lts central theme is the question whether it is possible to give an alternative foundation of contractual liability, given the fact that the so called reliance principle' ('Vertrauensprinzip') does not meet the standards of legal dogmatics in an appropriate manner. Thus it should be stressed that this book is not only concerned with the role of the reliance principle as a basis of liability in contemporary law, but also with the character of (continental-European) civil law itself.
