Show moreThis preliminary study had to address a number of key questions: What is the expected effect on the individual concerned and on society as a whole of introducing into the legislation the option of imposing a substitute community service order on an offender who fails to pay a fine issued under criminal law? What positive and negative consequences can be expected, and what are the grounds for these expectations? These questions have been studied by consulting relevant literature and documents, including parliamentary documents, analysing Central Judicial Collection Agency (CJIB) data and conducting 23 interviews with key individuals and experts within criminal law for youth and adult offenders. Show moreDe sanctionering van jeugdigen die zich schuldig maken aan een ernstig gewelds- of zedenmisdrijf is in Nederland al langere tijd onderwerp van politieke en maatschappelijke discussie. In dit onderzoek wordt in kaart gebracht welke sancties Nederland en andere Europese landen – België (Vlaanderen), Duitsland, Engeland en Wales, Ierland en Zweden – hanteren voor minderjarigen en jongvolwassenen (tot 23 jaar) die een ernstig gewelds- of zedenmisdrijf hebben gepleegd. Ook wordt onderzocht wat de effectiviteit van deze sancties is en hoe de diverse sanctiestelsels zich verhouden tot internationale en Europese kinder- en mensenrechten. Vervolgens wordt gereflecteerd op de vraag in hoeverre de bevindingen van dit onderzoek aanleiding geven tot aanpassing van de Nederlandse strafrechtelijke aanpak van jeugdigen die worden veroordeeld voor een ernstig gewelds- of zedenmisdrijf. Uiteindelijk resulteert het onderzoek in een aantal concrete aandachtspunten voor wetgeving en beleid en suggesties voor vervolgonderzoek die de wetgever en beleidsmakers beogen te ondersteunen bij het maken van goed geïnformeerde, weloverwogen en wetenschappelijk onderbouwde beslissingen omtrent dit vraagstuk. Show moreRefugee children often find themselves in a vulnerable position; they have experienced trauma and mental health problems and in the host country they are involved in a complex and adult-oriented asylum application procedure. International and European legal standards urge states to adapt migration procedures to the age and maturity of children and to make these more child-friendly. In this article, the core concept of analysis is the child’s right to information. It will be shown that this right is closely connected to other children’s rights and concepts, such as access to justice, child-friendly justice and the right to participation. The implementation in practice of the right to information in the asylum procedure in the Netherlands will serve as a case study, to show the precarious information position of both unaccompanied as well as accompanied refugee children. The results of this study show that the information position of these children can be improved, which will benefit their legal position, emotional wellbeing and possibilities to exercise their rights.
