Show moreDoor technologische ontwikkelingen wordt het steeds beter mogelijk om het gedrag van mensen te monitoren en bij te sturen. Rechtshandhaving door technologie kan veel effectiever en ingrijpender zijn dan door mense- lijke handhavers, zet de wetgever en rechter soms buiten spel en reduceert de ruimte voor burgerlijke onge- hoorzaamheid. Dit zorgt voor minder mogelijkheden rechtsregels ter discussie te stellen, hetgeen de rechts- ontwikkeling in de weg kan staan. In deze bijdrage worden parallellen getrokken met de evolutiebiologie om te illustreren dat het kunnen afwijken van de norm soms nodig is voor doorontwikkeling van het recht. Enige ruimte om de wet te mogen overtreden, bijvoorbeeld via burgerlijke ongehoorzaamheid of gedoogconstruc- ties, zorgt voor voldoende variatie en draagt bij aan een goede rechtsontwikkeling. Er is te weinig discussie over hoe we de toekomst graag zien. Dat stelt Bart Custers, hoogleraar Law and Data Science aan de Universiteit Leiden, in deze oratie, gehouden op 21 mei 2021.Een paar decennia geleden hadden we nog geen smartphones, gps-navigatie of drones. Alleen iemand met veel fantasie had destijds kunnen voorspellen over welke technologie we nu beschikken. Dat roept de vraag op over welke technologie we in de komende decennia zullen beschikken en hoe zal die ons leven beïnvloeden. We kunnen die toekomst zelf vormgeven, dus we moeten daarover veel actiever met elkaar in gesprek zijn. We kunnen immers zelf regelen wat we wel en niet ok vinden.De kunst is het vinden van een goede reguleringsbalans. Aan de ene kant willen we niet te veel en te gedetailleerde regelgeving. Dat maakt naleving en handhaving lastig en kan innovatie in de kiem smoren. Maar aan de andere kant loert het gevaar van gebrekkige spelregels met onvoldoende rechtsbescherming als gevolg. Show less

Show moreOnline and social media platforms employ automated recognition methods to presume user preferences, sensitive attributes such as race, gender, sexual orientation, and opinions. These opaque methods can predict behaviors for marketing purposes and influence behavior for profit, serving attention economics but also reinforcing existing biases such as gender stereotyping. Although two international human rights treaties include explicit obligations relating to harmful and wrongful stereotyping, these stereotypes persist online and offline. By identifying how inferential analytics may reinforce gender stereotyping and affect marginalized communities, opportunities for addressing these concerns and thereby increasing privacy, diversity, and inclusion online can be explored. This is important because misgendering reinforces gender stereotypes, accentuates gender binarism, undermines privacy and autonomy, and may cause feelings of rejection, impacting people's self-esteem, confidence, and authenticity. In turn, this may increase social stigmatization. This study brings into view concerns of discrimination and exacerbation of existing biases that online platforms continue to replicate and that literature starts to highlight. The implications of misgendering on Twitter are investigated to illustrate the impact of algorithmic bias on inadvertent privacy violations and reinforcement of social prejudices of gender through a multidisciplinary perspective, including legal, computer science, and critical feminist media-studies viewpoints. An online pilot survey was conducted to better understand how accurate Twitter's gender inferences of its users’ gender identities are. This served as a basis for exploring the implications of this social media practice. Show less

Show moreRansomware is malicious software (malware) that blocks access to someone’s com- puter system or files on the system and subsequently demands a ransom to be paid for unlocking the computer or files. Ransomware is considered one of the main threats in cybercrime today. Cryptoware is a specific type of ransomware, which encrypts files on computer systems. The ransom is often demanded in bitcoins. Based on desk research, a series of interviews, and the investigation of several police files, this paper investi- gates the modi operandi in which cybercriminals use ransomware and cryptoware to make profits and how they launder these profits. Two models, based on the payment of the ransom via vouchers and via bitcoins respectively, are identified and described. These methods allow criminals to launder profits in relative anonymity and prevent the seizure of the illegally obtained money. Show less
