Show moreCustomary international tax law has traditionally not received a lot of acclaim in international tax law literature. However, the infrastructure of international tax law is becoming increasingly multilateral. The recent adoption of the Multilateral Instrument and the creation of the Inclusive Framework, two initiatives related to the OECD/G20 Base Erosion and Profit Shifting Project, have accelerated the width of cooperation on international tax matters. For that reason, the authors (re)consider the existence of customary international law in the area of international tax law. They conclude that, perhaps contrary to the intuition of tax lawyers, the evidence in favour of customary international tax law is building up. The question whether customary law exists within the area of international taxation is therefore not misplaced. Show less

Om die vraag te beantwoorden, is een onderscheid gemaakt tussen materieel en formeel multilateralisme. Materieel multilateralisme kenmerkt zich door materiële verplichtingen, die niet in bilaterale afspraken kunnen worden opgedeeld zonder afbreuk te doen aan de raison d’etre van die verplichting als zodanig. Bij een formeel multilaterale afspraak, daarentegen, is weliswaar de vorm van het verdrag multilateraal, maar zijn de daarin voorkomende materiële verplichtingen desalniettemin bilateraal van aard. De verplichtingen van het MLI zijn in dit licht gekwalificeerd. Show less

Working from a normative and pragmatic view on international tax relations, he proposes a management-focused approach to multilateral cooperation in international taxation. The resulting managerial framework treaty is drawn up on the basis of insights from political science and legal philosophy and is illustrated by means of international public law. Finally, the author evaluates the recently-adopted text of the Multilateral Convention to Implement Tax Treaty Related Measures to Prevent BEPS (the BEPS Convention) in the light of his proposed framework. One is the field of international relations, and especially the "neoliberal" approach based on the economic self-interest of states. The other is political philosophy, and especially Brennan and Buchanan’s "veil of uncertainty". The authors argue that, as the economic gains of combating BEPS are uncertain, multilateral agreement will be easier to achieve on matters of design and concept, than on specific rules which have an uncertain distributive impact on states’ economies. The recommendations of the BEPS Final Report are, therefore, useful to the extent that they provide a starting point for reconsidering the architecture of international taxation, that is, for answering the question: "what would we want the taxation of multinational enterprise (MNE) profits to look like in 2025?"Show less

Show moreIn this article, the author examines whether or not article 31(3)(c) of the Vienna Convention of the Law of Treaties (1969) may justify recourse to the OECD Commentary to the OECD Model Tax Convention when interpreting tax treaties. It is concluded that, when considering the context of article 31(3)(c) of the Vienna Convention (1969), which particularly involves the ILC's Fragmentation Report, the Oil Platforms case and the case law of the ECtHR, it seems plausible to give an interpretative argument on the basis of article 31(3)(c) in order to justify recourse to the non-binding normative environment of a treaty.
