Hierbij dreigt het gevaar dat de (individuele) rechtsbescherming tegen de overheid, soms uit het oog dreigt te worden verloren. Het is aan de (straf)wetgever de verschillende bij nieuwe wet- en regelgeving de verschillende in het geding zijnde belangen continu voor ogen te houden en, indien er keuzes gemaakt moeten worden, deze verschillende belangen weloverwogen en consciëntieus tegen elkaar af te zetten. In dit onderzoek wordt aan de hand van een analyse van de totstandkoming van antiterrorismewetgeving inzicht gegeven in de wijze waarop maatschappelijke veranderingen in sociale structuren en culturele gevoeligheden, alsook veranderingen en ontwikkelingen in de politieke context, hun doorwerking hebben gevonden op deze lastige taak van de (straf)wetgever. Hierbij wordt eveneens stilgestaan bij de invloed van de (straf)rechtswetenschap. Een bezinning op de totstandkoming van de antiterrorismewetgeving en de belangenafweging door de wetgeving daarbij biedt inzicht in de legitimiteit en noodzakelijkheid, maar ook in de kwaliteit, van de desbetreffende wetgeving. However, their objective is constant, namely to fight forest destruction and poverty and to resolve conflicts regarding forest tenure. Securing community forest tenure is a way for achieving this objective. Forest tenure security, however, requires more than legalisation of community property rights by state law. It results from an interplay between state and/or community normative systems, actual practices and actors’ perceptions. Legalisation of rights by state institutions is only one facet of security, more specifically legal security of forest tenure that will be determined by the rights’ robustness, proper duration and strong legal protection. The security of community forest tenure will be also achieved through the ability of social norms to secure the rights of ordinary people. In addition, the consistent enforcement of the rules or norms by the officials or local authorities is necessary and the behaviour of these officials and local authorities must be in line with the interests and perception of the majority of community members. Last but not least, efforts of securing communities’ rights must take into consideration the specific history of land tenure and conflicts. Show less

Show moreWhy can vigilantes count on public support? Why do citizens in certain cases oppose the formal prosecution and punishment of vigilantes? Are such reactions an indication of lacking confidence in the criminal justice system? Or do situational aspects perhaps also play a role? The goal of this dissertation is to explain public support for vigilantism. In two studies, respondents were presented with a fictional case about vigilantism and answered related questions. The findings of both studies show that support for vigilantism cannot be interpreted automatically as a sign that confidence in the criminal justice system is lacking: situational characteristics have an independent influence on support. The results also reveal that support for vigilantism is a complex concept. People are not simply for or against vigilantism; responses to vigilantism are more nuanced. People can for instance feel little empathy for the victim of vigilantism, but at the same time express a desire for punishment of the vigilante. Additionally, a higher level of confidence in the courts and criminal justice system led to less support for vigilantism, while confidence in police did not play a role. Lastly, general support for vigilantism was an important predictor of support for a specific case. Show less

Show moreCorporate social responsibility (CSR) as a nominal term clearly resonates with scholars and practitioners alike. As a scientific concept, however, it has often been criticized for its lack of definitional precision and poor measurement. The upshot of this analysis is that since the CSR concept adds nothing of value to existing frameworks in the field of management and organisation, such as the economizing and legitimizing perspectives, it is best to discard it altogether. Generally, criticasters have also contended that CSR distracts from the fundamental economic role of businesses. From a different perspective, CSR has been criticised as being nothing more than superficial window-dressing. Along those lines, as one of the downsides, it has been asserted that CSR could become the victim of its own popularity. For example, the campaign group Friends of the Earth sees some companies’ interest in CSR as a cynical ‘PR exercise’. Hence, in their view, ‘greenwashing’ – self-styled ethical brands – could suffer a backlash from their own CSR spin. Another critical argument often disseminated is that CSR is an attempt to pre-empt the role of governments as a watchdog over powerful multinational corporations. Clearly, the CSR phenomenon has attracted strong positive and negative opinions from both scientists and society. On the one hand, the author agrees with the criticisms conversed; they provide a realistic view and certainly contain an element of truth. However, as will be demonstrated throughout this study, she also agrees with the view of Porter and Kramer. If businesses were to use the same frameworks that guide their core business, CSR could be effectively incorporated into the core operations and could become a source of opportunity, innovation, and competitive advantage for business, as well as a source of social progress. As will be explained infra, the author has chosen to direct her research towards legal and semi-legal frameworks that support and guide business organisations and to examine how these frameworks interact with CSR. Daarnaast wordt de vraag gesteld of de bescherming van de sollicitant respectievelijk werknemer in de proeftijd in verhouding tot het belang van de werkgever voldoende is en of verdere normering (al dan niet via een wettelijke regeling) is aangewezen. Voor de sollicitatiefase en regeling van de proeftijd wordt in het boek een vergelijking gemaakt met het Duitse rechtssysteem. Er bestaat reeds een NVP Sollicitatiecode. Gebleken is evenwel dat deze bij ondernemingen en instellingen onvoldoende bekend is. Wetgeving voor de werving en selectie zal dan ook eerst meerwaarde hebben als de sollicitatiecode bij de werkgever en sollicitanten voldoende bekend is geworden en in de wet een goed werkend sanctieapparaat is opgenomen. In haar algemeenheid is de rechtspositie van de sollicitant naar Duits recht niet wezenlijk beter of slechter dan de rechtspositie van de sollicitant naar Nederlands recht. De Duitse sollicitatieprocedure onderscheidt zich in positieve zin van de Nederlandse sollicitatieprocedure door de duidelijke informatie-uitwisseling middels de uitgebreide documentatie die op grond van het gebruik bij een sollicitatiebrief wordt gevoegd. In het proefschrift is een proeve voor een nieuwe proeftijdregeling opgenomen. Voor de totstandkoming van deze proeve is gekozen voor een combinatie van het Duitse en Nederlandse rechtssysteem. In de proeve heeft Kötter de voordelen van de proeftijd naar Duits recht, zoals de plicht tot feitelijke proefneming, het hanteren van een opzegtermijn bij opzegging van de arbeidsovereenkomst tijdens de proeftijd en het hanteren van een langere maximumduur (zes maanden) van de proeftijd in het belang van de feitelijke proefneming overgenomen. This study takes the proper explanation of the concept of value, as derived from the economists belonging to the Austrian School of Economics, as a starting point. During the last decades a mainstream approach to business valuation developed. This study treats the question whether this mainstream approach is based on the ideas about value which developed in the Austrian School of Economics. If so, how? If not, is it possible to derive insights from the Austrian School in order to improve the way we value in daily life?Businesses are capital goods and these are pivotal in creating wealth. Based on the Austrian perspective only real savings can lead to the existence of capital goods. The real world is not like most textbook models featuring a circular flow. Man is able to create value and obtain a higher level of wealth. As an important sidestep a flow model, based on a so-called Petrinet, was constructed to show the growth creating character of capital goods. In order to investigate the way mainstream economists and practioners determine economic value a framework was developed to structure both the theoretical approach and everyday practice. Two illustrative examples demonstrate how to calculate economic value based on Austrian principles. Show moreThis thesis intends to identify the systemic causes of corruption in China’s courts by firstly investigating how corruption is carried out in China’s courts. It employs an analytical framework, which treats corruption as a four-phase contracting process, namely 1) the phase of initiation of the exchange; 2) the phase of negotiation of the exchange; 3) the phase of contractual performance; and 4) the phase of enforcement of the contract in case of non-performance. This framework is employed in an endeavor to analyze the empirical data collected from various sources and to demonstrate in details the features and patterns of corrupt conduct in each of the four phases so as to identify more accurately which factor(s) has(have) facilitated corruption in China’s courts. In doing that, the thesis identifies two phases that are most critical to the completion of corrupt exchange. The first phase is the initiation phase, in which corrupt intent is communicated between potential exchange parties. The second phase is the phase of contractual performance, especially that of the bribed. These two phases are further examined, demonstrating how these two phases are completed by corruption participants in China’s courts and what factors have facilitated the process and contributed to its “success”. Niettemin doen zich binnen de context van de strafrechtspleging veelvuldig situaties voor waarin wordt gehandeld op basis van wilsovereenstemming tussen Openbaar Ministerie en verdachte. De transactie, het voorwaardelijk sepot en het instrument van toezeggingen aan verdachten in ruil voor een getuigenverklaring zijn hiervan enkele duidelijke voorbeelden. Hoewel deze op consensualiteit gebaseerde procedures zich in de loop der jaren een vaste plaats binnen de strafrechtspleging hebben weten te verwerven, vormen zij vanuit theoretisch perspectief een vreemde eend in de bijt van de strafrechtelijke vijver. Dit onderzoek geeft antwoord op een aantal belangwekkende vragen die rijzen naar aanleiding van het gebruik van op consensualiteit gebaseerde procedures binnen het strafrecht. In de eerste plaats wordt bekeken of deze procedures kunnen worden gezien als overeenkomsten, hetgeen voor een aantal van hen inderdaad het geval blijkt te zijn. Nu deze overeenkomsten betrekking hebben op (de invulling van) strafrechtelijke bevoegdheden, wordt gesproken van strafrechtelijke overeenkomsten. Daarnaast buigt dit onderzoek zich over de vraag in hoeverre de traditionele, op eenzijdigheid gebaseerde strafrechtelijke verhoudingen ruimte tot het aangaan van strafrechtelijke overeenkomsten bieden. Tot slot wordt de vraag bekeken op welke wijze de strafrechtelijke overeenkomst dient te worden genormeerd. Door gegevensontdekkende-, gegevensvolgende- en gegevenskoppelende technologieën erodeert de privacy van de burger in onze risico-toezichtmaatschappij ernstig. Het vertrouwen in het gebruik van ICT en het elektronisch zaken doen komt hierdoor sterk onder druk te staan.Er bestaat uitvoerige Europese wet- en regelgeving om onze privacy te beschermen. In dit boek is deze wetgeving geanalyseerd. De wetsartikelen die direct betrekking hebben op de verwerking van persoonsgegevens kunnen beschouwd worden als de juridische specificaties voor het ontwerp van informatiesystemen. De wetgeving verplicht tot een privacyrisico analyse voorafgaande aan het gebruik van informatiesystemen. Dit vindt nauwelijks plaats. In de traditie van onderzoekingen van E.M. Meijers en anderen die haar belang in de dertiende eeuw hebben aangetoond, toen zij een geduchte concurrent voor Bologne vormde, beschrijft deze studie een onderbelichte periode uit haar geschiedenis, die tijdens de Honderdjarige Oorlog. Aan de hand van de levensgeschiedenissen van vier van de meest invloedrijke professoren (Jean Nicot, Bertrand Chabrol, Géraud Bagoilh en Jean Noaillé) wordt het onderwijs in het civiele recht in Orléans tussen 1337 en 1428 in kaart gebracht. Naast gegevens over hun leven, hun werken en hun omgeving (leermeesters, collegae en leerlingen) toont deze studie enerzijds de invloeden die deze hoogleraren hebben ondergaan van auteurs uit Frankrijk en Italië; anderzijds laat zij de invloed van hun denkbeelden op andere centra van rechtsgeleerdheid in Europa zien. Yet, judicial review’s justification and its scope are seldom addressed in the same study, thereby making for an inconvenient divorce of these two related avenues of study. To narrow the divide, the object of this work is quite straightforward. Namely, is the idea of judicial review defensible, and what influences its design and scope? This work addresses these matters by comparing the judicial review of legislation in the United Kingdom (the Human Rights Act of 1998), the Netherlands (the Halsema Proposal of 2002) and the Constitution of South Africa of 1996. However, the rapid mobile diffusion among children and young people raises a number of crucial questions. In what way do mobile phones pose a threat to children and young people in terms of content, contact, and commercialism? What impact does the use of mobile communication technology have on children and young people? How might we seek to address the inadequacies in the existing regulatory framework with regards to the protection of this vulnerable group? The purpose of our investigations is to compare the regulatory measures as adopted in Hong Kong with regulatory practices and arrangements of other jurisdictions. Show moreThe thesis is concerned with the protection of users of Free Software. Free Software is available together with the rights to use, develop, and distribute them. The Free Software Definition specifies the exact scope of these rights (called “user freedoms”). The thesis presents a reconstruction and an analysis of the model of the current framework that regulates the protection of the freedoms.The reconstructed framework consists of rules that enable users to exercise their freedoms, as well as the rules that limit or restrict users in exercising them (so-called “inefficiencies”). The main operational practices are analysed in the world of software communities and in the world of eGovernments.Properly organized communities are able to minimize many inefficiencies materially. eGovernments are able to affect how the inefficiencies of the current framework impact user freedoms. Whether eGovernments improve the protection of user freedoms depends on what type of an eGovernment is introduced (open or closed eGovernements).All in all, it follows from the given analysis that the freedoms are not sufficiently protected under the current framework. Show moreIn several continental Western European legal systems, a person may be liable in person or through his property for payment of a debt which is not his. Both personal surety and a pledge which has been alienated by its owner come to mind. Under such circumstances, the question rises whether a creditor can attach the surety or the pledge before seeking payment from the debtor. According to classical Roman law, the creditor had a right to choose. However, emperor Justinian changed the law in this regard, forcing the creditor to first seek recourse against his debtor, even to the point of insolvency proceedings. This rule later became known as the ‘beneficium ordinis’ or ‘beneficium excussionis / discussionis’. Over the ages, the rule has come under severe attack, which resulted in it either being abandoned or modified, so as not to interfere with creditors’ rights. The author tracks these developments through the medieval European ‘ius commune’ into French law, Roman-Dutch law and modern Dutch law. The latter has extended the rule in 1992 for real security interests, while at the same time abandoning it for sureties. It is asserted that this was a mistake and the rule should be abolished entirely. Show less
