Show moreHet oostelijk deel van West-Friesland was in de midden- en late bronstijd (ca. 1600-800 v. Chr.) een dichtbevolkt gebied met vele boerendorpjes. Door de goede conserveringsomstandigheden is de regio een schatkamer van de overblijfselen uit die tijd. In deze studie zijn oude opgravingsgegevens uitgewerkt en vertaald naar nieuwe inzichten in de inrichting en ontwikkeling van dit indrukwekkende prehistorische cultuurlandschap. Een van de opvallende resultaten van dit onderzoek is dat de nederzettingsterreinen vaak vele generaties bewoond zijn, maar tegelijkertijd een dynamisch karakter hebben. Continuïteit was er op locaties waar een huisplaats is ingericht: nieuwe boerderijen werden vaak generaties lang op dezelfde plaats als de voorgangers gebouwd. Maar we zien ook dat huisplaatsen die generaties lang bewoond zijn geweest, op een zeker moment werden opgegeven en een andere functie krijgen. Door de lange bewoningsduur van terreinen en goede conservering en herkenbaarheid van grondsporen, zijn de Westfriese vindplaatsen bij uitstek geschikt om deze dynamiek in beeld te brengen. Veel beter dan elders in Nederland is het mogelijk inzicht te krijgen in de keuzes die men in de bronstijd heeft gemaakt bij de inrichting van het landschap. Dat maakt deze studie een ijkpunt voor bronstijdonderzoek in Nederland, maar ook in Noordwest-Europa. Show less

Show moreThis thesis deals with Dutch language education in primary schools in the eighteenth and nineteenth centuries. It focuses on the role of education in the development of Dutch as a standard language, with attention for educational practices, pedagogical discourse and passive exposure to language norms in school books. The transition from the eighteenth to the nineteenth century was marked by rapid societal and ideological changes. Part of these changes were reforms of the Dutch language and school system. Language was increasingly seen as a marker of national identity. Education in the national language became an important prerequisite for the development of a modern and national civil society. To facilitate national unity and language education, the norms for the Dutch language were officially codified. At the same time, new pedagogical ideals led to changes in the organization, means and methods of primary school education. Based on reports from the school inspection, pedagogical literature and school books, this thesis draws an image of theory and practice of Dutch language education in primary schools between 1750 and 1850. This requirement is particularly important for legislation that has financial consequences for citizens, such as tax legislation. The objective of this research is to provide an overview of the way in which the requirement of clarity regarding tax legislation has been filled in by the literature, by case law and by organizations working in the field of legislative advice. Based on the results of this research, the criteria that have to be applied to tax legislation can be categorized as conditions concerning i) the formulation of legislation, ii) the structure of a legal system, iii) the status of persons at whom legislation is adressed to and iv) the way in which the relevant rules are explained. A community will cease to exist when this criterion is no longer met. Termination of a community can take place in various ways. One of these ways to terminate refers to termination via apportionment. With effect from 1 January 1992, the legislature provided for the legal arrangement of apportionment in the law. The legal concept of apportionment has since been regulated in art. 3:182 DCC. Knowing whether or not a legal act should be classified as apportionment is of significant importance for civil as well as for tax law. In this study the focus is on the legal act of apportionment as defined by civil law. In addition, the study exclusively involves apportionment by mutual agreement. The overall aim of this study is to provide an evaluation of the legislative frameworks concerning apportionment as a juridical act according to Dutch civil law, by examining in particular the content and scope of apportionment based on art. 3:182 DCC. Show moreIn 1797 and 1798 the first steps were taken in the Netherlands towards the development of a democratic system. In 1796-1797 a written Constitution was drafted for the Batavian Republic, as the Netherlands was called at the time. This Constitution was in 1797 submitted in a national referendum for a vote of the people, but it was rejected. A new draft was written and again submitted the following year. This time the Constitution was adopted. Very little is known about these referenda. Extensive archival research has been necessary in order to understand how these steps in democracy were taken. It has been possible to produce a dataset of results for 948 cities, villages and rural districts. Based on the voting results, the public support for a democratic constitution has been analyzed after a description of the voting system. The voting results are examined along two cleavages structures. First, major distinctions existed between cities and rural districts and secondly between Catholics and Protestants. As a partial explanation the religious preferences are important to understand the turnout by the two referenda. Above all, the results of the two referenda show a deeply divided society of religious minorities. Show less

Show moreThrough the lens of individual believers, and on the basis of their own literary and visual output, this thesis investigates how post-Reformation Catholics in the Dutch Republic understood themselves. Offering for the first time a systematic and long term approach of the Catholic experience in the Dutch Republic, this thesis participates in an international scholarly debate about early modern Catholicism in Protestant states. In order to analyze how individual Catholics manifested themselves as mediators of Catholic identity and culture, this study introduces two theoretical frameworks, subculture and habitus; it is further organized around windows that represent new historical methods. This thesis brings to light, among many other things, that Dutch Catholics followed very different paths to adapt to their new social reality, revealing the complex nature of the Catholic subculture. This thesis also illustrates that Catholics purposely cultivated those parts of their habitus that were detested and ridiculed by the Calvinists, but to which the Calvinists, at the same time, remained receptive. By drawing a comparison with the Generality Lands, the transition from sub- to counterculture is explored. The analysis of the Catholic Schism of 1723 sheds further light on the dynamics within the Catholic subculture. Show less

De overheid moet geldschulden die voortvloeien uit sancties in beginsel invorderen. Anders heeft de sanctie weinig zin. Bovendien wordt de belastingbetaler benadeeld als niet wordt ingevorderd. In dit onderzoek wordt uitgezocht wanneer de overheid ondanks dit uitgangspunt toch niet mag invorderen. De kern van mijn onderzoeksvraag was: onder welke omstandigheden hoeft de burger toch niet te betalen? Ik heb mij daarbij gericht op een bepaald soort schulden aan de overheid, schulden die voortvloeien uit zogenaamde herstelsancties. Dit soort sancties richten zich niet op het bestraffen van iemand maar alleen op het herstellen van de situatie naar hoe die zou zijn geweest als er geen overtreding had plaatsgevonden. Denk bijvoorbeeld aan de overheid die ontdekt dat iemand ten onrechte een uitkering geniet. De terugvordering van die onterecht genoten uitkering is geen straf, maar alleen maar het herstellen van de situatie naar hoe die was als de uitkering nooit was uitbetaald. Show less

Show moreThis PhD-thesis analyses the relationship between the parties’ choices in the CPB Netherlands Bureau for Economic Policy Analysis’ assessments of the election manifestos and coalition agreements over the period 1986-2017, and tries to explain this relationship. First, the theoretical framework is set out, in which agenda-setting, political economy and civil service influence have prominent positions, followed by a description of the political rationality and the civil service rationality. Then, multiple reflections are made on the history of the assessments and their (dis)advantages for both the Dutch politicians and the civil service. Second, the empirical analysis of the parties’ choices with regard to government expenditures, tax burdens, purchasing power and macroeconomic outcomes in election manifestos and coalition agreements is carried out. It appears that for the majority of parties’ choices, negotiators in the formation decide in line with their manifestos. But there are also clear deviations. In general; government expenditures turn out higher, except the expenditures on education. Tax burdens end up higher, but foremost for households while companies receive tax reliefs. The purchasing power of high incomes and middle incomes falls behind, in contrast to the purchasing power of social security beneficiaries and low incomes which end up better. Show less

Show moreWat kan literatuur betekenen voor het recht en de rechtsvinding? Literatuur komt in opstand tegen een abstracte, wetenschappelijke benadering van de ander. Zij ontsluiert concrete werelden en personages en vraagt aandacht voor het horen van de menselijke stem in het recht. Dat is de literaire benaderingswijze van ‘Recht en literatuur’, die ijvert voor een meer persoonlijke benadering in het recht en zich richt op humaniteit en erkenning van de ander. Door het lezen van literatuur kan de rechter een zeker empathisch vermogen en verbeeldingskracht ontwikkelen dat het oordeelsvermogen ten goede komt. Dit pleidooi van de zogenoemde ‘narratieve rechtsethiek’ voor empathie en menselijkheid is belangrijk in weerwil van een wetenschappelijke opvatting van het recht. Deze recente inzichten in ‘Recht en literatuur’ roepen echter vragen op. In hoeverre slaagt ‘Recht en literatuur’ in het bieden van een alternatief dat rechtvaardigheid en menselijkheid realiseert? Wordt de narratieve rechtsethiek zelf niet ook geconditioneerd door blikveld beperkende doctrines en dogma’s? Is het empathisch vermogen inderdaad toereikend om de ander te leren kennen? Wat is precies de kracht en de reikwijdte van de poëtische benadering? Show moreThis thesis on the corporate history of the Concertgebouworchestra reveals that the culture of regents of the Concertgebouw gave the chief conductor more leeway than the orchestra's director from the start, paving the way for a dominant position of the orchestra leader. Willem Mengelberg, a prominent man with a turbulent life, stipulated not only the artistic but also part of the corporate policy of the Concertgebouw orchestra, and was forceful in doing so. Thus 'model' regulary caused tension involving the talented conductor himself and, at a later stage, his successors. Given the fact that the board had few checks ans balances at its disposal to channel these tensions, conflicts could easily spin out of control. Although several aspects of these problems have been touched upon in literature before, they have never been interpreted and intergrated as in this thesis. This book clearly demonstrates that the Mengelberg model had a major impact on the way chief conductors were looked upon and on the mark they put on management. Thus, a fresh view emerged on a nineteenth-century institution searching its way into the twenty-first century. Within this quest, the entrepreneurial spirit of the Concertgebouw orchestra was slow to appear. Show less

Show moreAt the end of the eighteenth century the Enlightenment brought forth new ideas on colonial relations and colonial policies. How did these ideas manifest themselves in early nineteenth-century literary fiction?Vaders en dochters (Fathers and daughters) focusses on three narratives about dramatic events in Moluccan history: a narrative poem by Jan Fredrik Helmers (1812), a short story by Maurits Ver Huell (1837) and a historical novel by Willem Ritter (1844). In all three the main characters are a father and a daughter. These narratives are extensely researched and analyzed. By taking in account more recent historical and antropological findings, an attempt is made to trace the emergence, rise and downfall of Enlightenment idealism in nineteenth-century historical romance.The stories of Helmers, Ver Huell and Ritter inspired other nineteenth century narratives, both literary and historical. In time some parts were integrated into Bandanese and Ambonese local histories, while the female character of Ver Huells story nowadays is considered a national heroine of Indonesia. In conclusion a postcolonial novel by Y.B. Mangunwijaya, likewise about a father and daughter in the turmoil of Moluccan history, is discussed to highlight the merits and deficiencies of Dutch colonial fiction. Show less

Show moreLitigation arising from civil disputes can be costly. In the Netherlands, as a rule, the successful party is able to recover the costs from the losing party only up to a liquidated amount. Higher costs would not be compatible with the fundamental right of access to justice. Since 2006/2007, the costs shifting rule of art.1019h of the Dutch Code of Civil Procedure has been applicable to intellectual property cases. On the basis of this article, costs may be shifted in full to the losing party. This article reflects the broad implementation of art.14 of the Enforcement Directive. The notion underlying this rule is that the prospect of a substantial recovery of costs ought in fact to broaden access to justice. The extensive, full costs orders have important consequences for parties in IP disputes. This book addresses the issues that have arisen in the context of the implementation, interpretation and application of cost shifting rules in IP disputes. Additionally this thesis addresses the broader issues of the increasing European influence on national procedural law, the consequences of the use of open norms in procedural rules and the link between costs shifting rules and the accessibility of the courts more generally. Show moreMany cities advertise services especially for expats, but who are they and why do we welcome them? Are they the ideal migrant, employee and citizen? In this historical study of expats in The Hague and Jakarta in the postwar period, their settlement process in the city is studied from a long-term perspective and on the basis of empirical data from the archives of municipalities, embassies, expat clubs and school, as well as interviews. This study shows that the postwar and postcolonial period witnesses the rise of a new generation of expats who have a more diverse profile when it comes to their nationality, social background, profession, career and family situation. As a result it are no longer only nation states, as was the case in the colonial context, but also private companies, international organizations and urban governments that play an important role in their settlement process. Because expats have more international careers we also see a standardization process occurring in the way expatriate communities organize around the world. This study, however, also urges city governments to remain aware of the specific profile of the expatriates they attract and how internationalization processes affect the opportunities of other citizens in the city. Show moreHoe verhoudt de voorlopige hechtenispraktijk in het Nederlandse jeugdstrafrecht zich tot de fundamentele rechten van minderjarige verdachten, zoals die zijn erkend in internationale en Europese kinder- en mensenrechtenverdragen en -richtlijnen? Dat is een vraag die de gemoederen al enige tijd bezighoudt. In de afgelopen jaren zijn door verschillende instanties, waaronder het Kinderrechtencomité van de Verenigde Naties, zorgen geuit over de toepassing van voorlopige hechtenis van minderjarige verdachten in Nederland. Dit onderzoek analyseert de functie, de juridische inbedding en de toepassingspraktijk van de voorlopige hechtenis in het Nederlandse jeugdstrafrecht in het licht van het kinder- en mensenrechtelijke verbod op onrechtmatige en willekeurige vrijheidsbeneming. Op basis van observaties bij verschillende rechtbanken en interviews met rechters, officieren van justitie, advocaten en professionals van de Raad voor de Kinderbescherming, jeugdreclassering en justitiële jeugdinrichtingen ontstaat voor het eerst een goed beeld van de voorlopige hechtenispraktijk in het jeugdstrafrecht. Het onderzoek resulteert in concrete aanbevelingen voor de wetgever, beleidsmakers, rechterlijke macht en andere betrokkenen in de rechtspraktijk. Daarmee biedt dit boek een unieke inkijk in de praktijk van voorlopige hechtenis en schetst het een toekomstbestendig scenario voor een jeugdstrafrecht dat beter recht doet aan de belangen van minderjarigen en die van de samenleving.
