Show moreThis study examines the ‘descriptions of cities’ or ‘urban historical topographies’ that were published in the seventeenth-century Dutch Republic. Its questions are: What are the conceptual foundations of the genre? What are the underlying principles that determine the topics that the authors choose and how they approached them? In the chapter-length introduction the genre is defined and an overview is given of the urban topographies published before 1700, situating them in their political and social context. Aspects of production and reception, belonging to the field of book history, are also discussed. An answer to the study’s main questions is attempted in six chapters. Chapters 2-5 discuss the four most important disciplines that influenced the genre: chorography, encomiastic literature, travel methods, and antiquarian research. Two concluding chapters present two case studies, focussing on the cities of Delft and Leiden in the province of Holland. The first shows how these disciplines converged in urban historical topographies. The second situates them in an international context. Show less

De evolutietheorie bleek decennialang onverenigbaar met 'eenvoudighistorische' en vrijwel letterlijke lezing van het scheppingsverhaal in het eerste Bijbelboek Genesis die in de GKN gangbaar was. Kerkelijke gezagsdragers, theologen en natuur-onderzoekers voerden hier verhitte debatten over, zo laat Kruyswijk zien. De ontzuiling van de jaren zestig van de twintigste eeuw droeg ertoe bij dat gereformeerde natuuronderzoekers deze lezing van Genesis niet langer konden volhouden. Mede door hun toedoen namen de GKN in 1981 officieel een narratieve interpretatie van de Bijbelse geschiedschrijving aan. Principiële bezwaren tegen de evolutie-theorie waren daarmee weggenomen. Today, we tend to conceive of ministerial responsibility as a rule. Unquestioningly it is assumed that ministers are responsible solely to parliament for all their acts. Originally however, ministerial responsibility was a relational concept, which referred to the relationship between crown, cabinet, (Second) Chamber and constituencies; the four __c__s__. Ministerial responsibility was so to speak an instrument to keep those four constitutional powers in balance. In the period 1848 to 1905 eventually one interpretation came to the fore. In spite of this still dominant interpretation ministerial responsibility is essentially a relational concept providing for a constitutional equilibrium. In the build-up to the constitutional revision in 1848 the Second Chamber already tended to perceive ministerial responsibility as the trust it could put in a minister. The opinion in Dutch legal literature that ministerial responsibility and parliamentary confidence have to be separated from each other is not tenable in that respect. The relationship between cabinet and constituencies played a part in the April-movement in 1853, when Thorbecke__s cabinet was blamed for inadequately informing the people. In the period 1866-1868 liberals and conservatives fought for supremacy in politics by way of a verbal sword-play about the meaning of ministerial responsibility. Show less

John was influenced intellectually by his father, the emperor Leopold II, and Johannes von Müller, a Swiss historian of the early romantic school. John of Austria saw that limited warfare was something of the 18th century, and tried to realize a style of warfare that he thought would be more suited to a people's war. The survey ends with a chapter on the war of 1809, looks into Johns experiences in its campaigns and concludes that the Austrian defeat meant the defeat of the reform party in Habsburg politics as well. The coexistence of multiple monitoring mechanisms in the same field can raise important questions concerning overlap, collision and alignment. The subject of this study relates to the coexistence of the European Court of Human Rights (ECtHR) and the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT) and focuses on the relation between these bodies from an organisational, terminological and normative perspective. It concentrates on answering the question how the relationship between the ECtHR and the CPT can be described and whether the current status between these bodies contributes to an effective and efficient protection of detainees against torture and inhuman or degrading treatment or punishment. Show moreDe fiscale beleidsvrijheid van EU-landen is de afgelopen jaren flink ingeperkt en met dit onderzoek wordt duidelijk gemaakt hoe moet worden beoordeeld of de wetgever binnen de grenzen van het EU-recht is gebleven. Daarnaast wordt onderzocht in hoeverre de soms forse kritiek op het Europese Hof terecht is. De conclusie is dat deze kritiek niet geheel terecht lijkt. Het onderzoek heeft geresulteerd in een toetsingsmodel aan de hand waarvan kan worden beoordeeld hoe de tegengestelde uitgangspunten van nationale fiscale soevereiniteit en het Europese vrije verkeer met elkaar moeten worden verzoend. Aangezien onverkorte uitvoering van één van beide beginselen zou leiden tot de non-existentie van het andere beginsel, moet het conflict tussen beide beginselen worden opgelost in een optimaliseringsproces. Waar ligt het punt waar beide beginselen zoveel mogelijk tot hun recht komen? Het model maakt het mogelijk op meer gefundeerde en gestructureerde wijze kritiek op het Hof te leveren. Bovendien kunnen fiscale beleidsmakers beter inschatten in hoeverre nieuw fiscaal beleid de Europese toets zal kunnen doorstaan Show less

Leiden was tussen 1760 en 1860 een broedplaats van culturele activiteiten. Als literair centrum wist het nationaal de aandacht te trekken.Na de culturele bloeiperiode van de late zestiende en vroege zeventiende eeuw was de stad een minder prominente plaats gaan innemen, maar in de tweede helft van de achttiende eeuw vond er een heropleving plaats. Tot in de tweede helft van de negentiende eeuw nam Leiden opnieuw een sleutelpositie in.Naast Bilderdijk woonden en werkten in de stad ook andere bekende auteurs, zoals Nicolaas Beets (Hildebrand), Johannes Kneppelhout (Klikspaan) en François HaverSchmidt (Piet Paaltjens). Bovendien was er een breed scala aan dichtgenootschappen, leesgezelschappen en leesbibliotheken. Ook de Schouwburg, de vele boekverkopers en de tijdschriften droegen bij aan dit literaire klimaat.In deze roerige tijd vervulde de literatuur een sociale functie. Dit boek laat zien hoezeer de letterkunde verweven was met historische gebeurtenissen zoals de strijd tussen patriotten en prinsgezinden, de buskruitramp, de Belgische Opstand en de revolutie van 1848, en het zoeken naar nationale eenheid en identiteit.Tegelijkertijd schetst het boek een levendig beeld van het literaire leven in een Hollandse provinciestad. Show moreIn the period between the world wars the Rotterdam author Jo Otten revealed a view of the world in his writings that can be called fairly unique in Dutch literature. The first fruits of Otten's pen were born during his education, when he studied Trade Economics. These are texts steeped in a melancholic atmosphere and betray the thinking of the French poet Charles Baudelaire. Over the years Otten became convinced that everything in life was dependant on a position of satisfaction. In his critical work he reacted to stagnation by pleading for a 'mobile' way of life, where everything was constantly on the move. It describes the hyper-awareness of the modernist: a person subject to doubt, who resists stagnation and reflects this in his work. Otten introduced his critical view of the world in the essay Mobiliteit en revolutie (Mobility and Revolution) (1932). In this essay he applauded the 'mobile person', an autonomous, chameleon-like figure who tries to escape social stagnation in various ways, some of them even surrealistic. Otten put into words the fundamental unrest that is the consequence of such a way of life in his kaleidoscopic novella Bed en wereld (Bed and World) (1932). Show less

Onderzocht wordt wat dit gegeven betekent voor de inrichting van de procedure bij de bestuursrechter. Sociaalpsychologische inzichten over procedurele rechtvaardigheid en over escalatie en de-escalatie van conflicten worden hierbij betrokken. Show moreBetween 1213 and 1484, numerous towns came into being in the counties of Holland and Zeeland, resulting in the rapid transformation of Holland in particular, into a “landscape of towns” where a large proportion of the county’s population – well above the average for that period - came to live. The research forming the basis of this book aimed at establishing the effect of the granting of town privileges (or city rights) with regard to the creation of these towns from both a historical and a legal-historical perspective. This was done along three lines. First, the historical circumstances accompanying the granting of specific town privileges have been assessed. Secondly, it has been established whether the granting of town privileges had been used as an instrument for attaining certain political goals and if so, in what manner. The third line was to discover which party - either Count or citizens - could be seen as the main instigator behind the granting of these privileges. This research subsequently focused on town privilege affiliations and on the hierarchical relations between town privileges. Finally, the contents of the town privilege charters were subjected to a legal-comparative analysis. Show less

Show moreThis book is entitled ‘The Dutch Law on Higher Education’. It concerns the law relating to higher education, which includes both academic education and higher professional education. It also relates to the institutions that are responsible for providing education: the universities, the universities of professional education, the Open University and other higher education institutions, as well as those organisations that are closely connected to them. These comprise the teaching hospitals, the Netherlands Organisation for Scientific Research (NWO), the Royal Netherlands Academy of Arts and Sciences (KNAW) and the National Library of the Netherlands (KB).The law on higher education is largely set out in legislation, both government legislation and regulations established by the institutions. The jurisprudence of the different courts is also important. This dissertation does not address the internal regulations of the institutions ad these differ from institution to institution and therefore have a limited local significance. The most relevant form of legislation for this dissertation is the Higher Education and Research Act (WHW), which regulates not only the relations between the institutions and the government, but also those of the institutions and their staff and students. This Act stipulates prescriptions – at times very detailed – on the internal business of these institutions, such as how their management boards are structured and the arrangements for co-participation by staff and students. The WHW to a large extent determines the relationship between government and the institutions. The assumptions about the question of what form this relationship should take and what the responsibilities of government and the institutions should be in the area of higher education have undergone considerable change in the course of time. This can be seen in the regular amendments to the legislation on higher education that have been introduced over the years. The question is whether the division of responsibilities of government and higher education institutions as set out at a particular point in time are still adequate and whether it is possible to increase the independence of the institutions in relation to that of the government, naturally without prejudicing the responsibility of the government. The primary aim of this work is to provide an answer to this key question. To facilitate this aim, this dissertation will describe and analyse thematically current higher education law based on the WHW. The subjects that will be addressed include: institutions, the open education system and regulation, quality assurance and accreditation, funding, teaching, examinations and the awarding of diplomas, staff, students, the management structure of the institutions, co-participation, legal protection for staff and students and the relationship between the universities and the teaching hospitals. Before accepting a position at the university in Leiden at the age of 67, Clusius spent a large part of his career at the courts of emperors, princes and aristocrats in Middle-Europe. There he met a wealthy and well-educated elite, who shared his passion for plants, gardens and travelling. But he also encountered a rich diversity of interests and approaches regarding the study of plants. These differences were used by Clusius to establish his authority as a professional botanist and to determine the standards for the proper scientific study of plants. Show less

Lang niet alle klachten blijken gegrond, maar het is een feit dat de politie diep kan ingrijpen in de rechten van de burger. Dit onderzoek geeft antwoord op een aantal belangwekkende vragen die in dit verband rijzen. Aan de hand van welke normen beoordeelt de Nationale ombudsman het optreden van de politie? Hoe verhoudt zijn toezicht zich tot dat van de strafrechter en het Europese Hof voor de Rechten van de Mens? En: wat is het effect van uitspraken van de Nationale ombudsman op de politie? Neemt de politie deze oordelen ook daadwerkelijk over en past ze haar gedrag aan? In deze studie is gekozen voor een multidisciplinaire aanpak: enerzijds een juridische analyse van de uitspraken van de ombudsman, en anderzijds een sociaalwetenschappelijk onderzoek naar de doorwerking van deze uitspraken bij de politie. Het geeft inzicht in de wijze van oordelen door de ombudsman en in hoeverre zijn oordelen aansluiten bij of afwijken van andere rechtsprekende instanties. Ook wordt duidelijk op welke wijze doorwerking plaatsvindt en welke factoren daarbij een rol spelen. Beantwoording van de onderzoeksvragen is niet alleen van theoretisch belang. Daarom zijn op basis van dit onderzoek aanbevelingen geformuleerd voor zowel de Nationale ombudsman als voor de politie. Show less

At closer inspection, however, a rather telling relationship is made manifest. At least in the Indonesian archipelago, where the traditional dwelling and its central role in the way the built environment of old is symbolically dealt with as well as experienced are seen to relate the sphere of the ancestral shrine to that of the souvenir. This particular way of symbolically dealing with the built environment and of experiencing it, are here, in this Ph.D. thesis, defined as house symbolism and constitute the starting-point of an investigation into the traditional vernacular architecture of some ten ethnic groups living in the archipelago. Navalisme ziet maritieme expansie als noodzakelijk voor het voortbestaan van een mogendheid. De eerste keer, vanaf 1912, vielen de gevolgen mee. De tweede keer, vanaf 1936, waren ze dramatisch: ze draaiden een onderzeebootstrategie met de meest efficiënte onderzeeboottactiek ter wereld de nek om. De successen van de Nederlandse onderzeeboten in de Tweede Wereldoorlog, hoe spectaculair ook, waren een schim van wat zij hadden kunnen zijn. Dit proefschrift schrijft een nieuwe geschiedenis van de Koninklijke Marine, die haar overzeese expansie wilde behouden via overambitieuze ‘risicostrategieën’, waarmee zij pretendeerde een sterkere zeemacht tot onmacht te kunnen verlammen. Die sterkere zeemacht was de reusachtige van Japan. De hoofdtaak van de Koninklijke Marine was namelijk de verdediging van het eilandenrijk Nederlands-Indië waarop Japan zijn zinnen kon zetten. Duidelijk wordt hoezeer het Nederlandse marinedenken van 1912-1942 parallel liep aan het Duitse èn dat de Duitsers niet de enigen waren die een ‘risicostrategie’ hanteerden (wat tot rivaliteit met Engeland leidde): de Amerikanen waren ze voor. Ook wordt duidelijk waarom de Amerikaanse strategie wel werkte en beide andere niet. Zo ontstaat ook nieuw inzicht in de Amerikaanse en Duitse marinestrategie Show less

Show moreThe Dutch East India Company, the VOC (Verenigde Oostindische Compagnie ) was founded in 1602 and was the first company with permanent capital, tradable shares and limited liability. Its aim was to monopolise the trade in valuable spices as nutmeg, mace and cloves found only in a remote part of the Indonesian Archipelago. This trade had been in the hands of the Portuguese. The first major steps were taken by Jan Pieterszoon Coen (1587-1629) who founded Batavia on Java in 1619 and in 1621 seized the monopoly of nutmeg and mace in a merciless campaign in the Banda Archipelago. Antonio van Diemen (1593-1645) entered the service of the VOC under a false name after his bankruptcy as merchant in Amsterdam to escape his creditors. Under the protection of Coen, he quickly moved up the ranks. The tenure of Antonio van Diemen as governor-general (1636-1645) was decisive for the VOC. Before Van Diemen was appointed, the Company had been avoiding a direct confrontation with the Portuguese. In audacious campaigns the Portuguese were dealt a definitive defeat. It concluded the phase during which the Company established primacy over the sea trade in Asian waters. This state of affairs would continue until far into the eighteenth century. Show less

Show moreDrift en koers (Passion and control) is the first scientific biography on the Dutch socialist, sociologist and feminist Hilda Verwey-Jonker (1908-2004). She is best known for the introduction of the word allochtonen (foreigner/alien) in the Dutch discourse and has very been influential in improving the (legal) status of especially married women. The questions her autobiography provoke were the starting point of my research. I present the results of my investigations into her lives as a passionate socialist, Protestant, intellectual, governor, expert in the field of refugee and migrant issues, ‘grey panther’ and mother of four children in fourteen chapters and fifty images. In the epilogue I present answers to the questions Verwey-Jonkers memoires raise and connect them with the notion that women are not supposed to fight in public. I thus present a new explanation for the very slow entry of women into Dutch parliamentary politics Show less

In tegenstelling tot zijn beroemde tijdgenoten lag zijn kracht niet bij het doen van grote ontdekkingen. Wel had hij een uitzonderlijk talent voor het verhelderen van complexe vraagstukken in de fysica. Het leven en werk van Ehrenfest biedt een intrigerend perspectief op de manier waarop wetenschappers uit dat tijdsgewricht hun weg probeerden te vinden in een periode van roerige wetenschappelijke, maatschappelijke en politieke ontwikkelingen. Behalve dat Ehrenfest een bloeiende onderzoeksschool opbouwde droeg hij ook bij aan de ontwikkeling en internationalisering van de Nederlandse natuurkunde, het universitaire onderwijs, en het ontstaan van een nieuw vakgebied __ de econometrie. Hij stimuleerde de ontwikkeling van de Russische en Amerikaanse theoretische fysica en versterkte de band tussen universiteit en industrie. This doctoral thesis describes the cultural history of Dutch church architecture in the twentieth century, a period in which more than 5,000 churches were built in the Netherlands. The majority of... Show moreThis doctoral thesis describes the cultural history of Dutch church architecture in the twentieth century, a period in which more than 5,000 churches were built in the Netherlands. The majority of these houses of worship are not listed buildings and suffer from a lack of maintenance. Because of the country’s overwhelming secularization, more and more churches are vacant, for sale or slated for demolition. The absence of any general study of the function and significance of modern churches in the Netherlands complicates the discussion in religious, cultural and political circles about the future of this vulnerable group of buildings. One major factor in the design, decoration and organization of these churches was the liturgical renewal within the Roman Catholic Church and two Protestant religious communities, the Nederlandse Hervormde Kerk and the Gereformeerde Kerken in Nederland. The democratic impulse to foster greater participation in services by the congregation had an aesthetic dimension. At the same time, demographic and urban developments put pressure on congregations to construct new churches at a rapid pace. Priests and pastors looked to architects to accommodate their liturgical and pastoral preferences by designing distinctively modern churches. In the late 1960s, both Catholic and Protestant churches became functional houses of worship, drained of their traditional sacred character. Show less

Show moreDeze dissertatie concentreert zich op de vraag hoeveel studenten in Leiden studeerden in de periode tussen 1575 en 1812 en welke achtergrond zij hebben. In het verlengde daarvan ligt het onderzoek naar wat de gevolgen voor de stad waren van de komst van studenten. De voornaamste bron om antwoord op deze vraag te geven is het album studiosorum. Mijn digitale bewerking ervan biedt naast reguliere tellingen van aantallen en achtergronden veel extra mogelijkheden, zoals bijvoorbeeld het leggen van kruisverbanden tussen herkomst, studierichting en leeftijd. This dissertation focuses on the questions of how many students were studying in Leiden in the period between the foundation of the university in 1575 and 1812, and what their background was. What were the consequences of the arrival of students for the urban society? The main source to answer these questions is the album studiosorum. I scanned and OCR-ed the printed version of the Leiden album studiosorum. Other sources for my thesis were the proceedings of the academic tribunal, administrative regulations of the university, moralistic writings and many personal documents. Show less
