Show more To an increasingly greater degree, incidents and crises are dominating daily life. In this context, mayors are seen as the guardian of local society. As commander-in-chief of the municipal crisis authority, with increasing frequency they are confronted with the extremely difficult task to manage crises effectively. Mayors are expected by many to display more leadership during crises than during normal day-to-day practice. This thesis describes research into antecedents, moderators, outcomes and contingencies of effective leadership behaviour during times of crisis, paying particular attention to the performance of mayors, as heads of local authority, in the Netherlands in their role of crisis manager. What determines the success of the leadership of mayors during crises; their personality, the leadership context (its possible variations), or both? It was demonstrated that agreeableness differs in relevance for autocratic and participative leadership behaviour of the mayor. The extent to which the leadership behaviour in question is effective, was shown to also be determined by the situation. Where an autocratic line of action is sometimes inevitable—when there is high time pressure, the effectiveness of participative leadership behaviour can be connected to different team processes, especially when the crisis situation is characterised by a high level of ambiguity. Show more Along the Rapenburg, the main canal in the town of Leiden, stands the Bibliotheca Thysiana. Founded in 1655, it is the only purpose-built seventeenth-century library in the Netherlands. The building contains several thousands of books on all kinds of subjects, including classical literature, theology, philosophy, law, history, science, mathematics, astronomy, medicine and botany. Most of these books were collected by the jurist Joannes Thysius. In his testament, drawn up only a few days before he died at the age of 31, Thysius declared that his books should be placed in a public library in order to be used by scholars. In this dissertation, Thysius’ motives for collecting books are reconstructed on the basis of his personal life, and in relation to contemporary literature about the nature of an ideal library. Furthermore, a comparison is made between his collection and those of contemporary scholars and professionals in order to determine whether he succeeded in composing a library that would suit his purpose. Show moreWithin the framework of social law, the position of temporary agency work has always been a source of some debate. There is an area of tension between the aim for more flexible types of labour on the one hand and maintaining decent labour relations on the other. For that reason the ILO has engaged in private labour intermediation ever since it was founded. While there was a tendency to forbid, or at least restrict private intermediation in the early years, gradually it became more accepted that, among others, temporary agency work had its merits and that a total ban was useless. In 1997, this culminated in ILO-convention 181, which received wide support. This did not put a stop to the discussion about non-standard types of paid employment. Which types of labour can be considered decent? How do they relate to the human rights? What are the effects of globalisation? At the European level, too, close attention was paid to (for instance, cross-border) temporary agency work. Lastly, the Netherlands itself has it own unique type of public-private regulation. The starting point is the question whether Convention 181 still has value. What are the developments in the social domain with regard to temporary agency work? How do they relate to the various types of flexible labour that are gradually catching up with temporary agency work? The fact that Convention 181 features among the most ratified ILO conventions that have been effected since 1990 makes clear that it is clearly meeting a need. While Convention 181 has met with policy competition from developments such as: decent-isation, human rightification, IFA-isation and Europeanisation, they have not affected its value. Convention 181 advances decent flexibility and fights informal labour and human trafficking. Show less

Show more The Our Lady Cathedral in Tournai is today one of the most remarkable churches of the Low Countries. In the Middle Ages, it was the mother church of the most northern bishopric of France. The early 12 Century Cathedral was built during a highly turbulent chapter in the history of the bishopric. After five centuries in personal union with the diocese of Noyon, and a long struggle for independence, Tournai recovered its own bishop in 1146. The architecture of the new early 12 Century Cathedral was to represent the venerable age of the Church of Tournai and its original independence. The triconchos (trefoil) ground plan points to the martyrium churches: it recalls the ideal of the early Church and its local saintly founder. The impressive group of five towers refers to the future, being a prefiguration of the Holy City Jerusalem that will descent on earth at the end of time. The strength of the Cathedral as a representation of the episcopal see of an independent bishopric of Tournai was visualised in the attribute of Eleutherius, the new patron saint: a model of the group of five towers forms a concise summary of the architecture of the Cathedral. The original question underpinning this project was: what influence do chaos, entropy and fragmentation have on the viability of the rapidly developing urbanizing world? In the course of the research project, the (literature and field) explorations led to the assumption that there is a demonstrable and necessary link between the quality of life in the city and vital social cohesion on the one hand and chaos, entropy and fragmentation on the other. In the artistic part of the research focuses on the question: is it possible to make the supposed connection between quality of urban life and chaos, entropy and fragmentation visible in artwork and, if so, how? In the written dissertation, working methods and strategies are contextualized and analyzed. The visual part derives from an artist's position which uses non-verbal, sensorial strategies to reach new insights. It mainly focuses on the visual and aesthetic possibilities of aspects of fragmentation, chaos and entropy because Scholten considers these aspects, as productive forces, to be the core of the experience of urbanization. Show moreInlichtingen- en veiligheidsdiensten moeten tegenover de buitenwereld zwijgen over wat zij precies uitvoeren en weten. Ministers, Kamerleden, journalisten, klagende burgers en ambtenaren hebben zich desondanks door de jaren heen intensief - en sinds het vroegste begin - bemoeid met het doen en laten van hun geheime diensten. In meer en mindere mate hebben zij zich in het licht van steeds andere gebeurtenissen een beeld gevormd van de toegevoegde waarde van de veiligheidsdiensten. Ze voerden een discussie zonder eind over de vraag wat die diensten wel én wat ze nadrukkelijk niet moesten doen. Voor de buitenwereld van de Nederlandse veiligheidsdiensten is in de historiografie nog niet veel aandacht voor geweest. Dit proefschrift probeert in die lacune te voorzien door licht te werpen op de wisselwerking tussen de veiligheidsdiensten en hun politieke, ambtelijke en maatschappelijke omgeving. In verschillende periodes in de twintigste eeuw wisten verschillende spelers in de omgeving van de veiligheidsdienst invloed uit te oefenen op de dreigingspercepties, organisatiewijze en legitimiteit van de veiligheidsdiensten. Dat leverde per saldo een nieuw soort veiligheidsdienst op. Waar bijvoorbeeld de Centrale Inlichtingendienst in de jaren twintig, in handen van de bewaarders van openbare orde en veiligheid, vooral in het teken stond van revolutiebestrijding, moest de Binnenlandse Veiligheidsdienst in de jaren zestig als gevolg van maatschappelijke protesten toch vooral democratisch en responsief zijn. Deze aanpak laat zien op welke manier politici, ambtenaren en burgers met hun eigen vijandbeelden op het netvlies steeds een nieuwe veiligheidsdienst schiepen. Show less

Show more Al tientallen jaren streeft de Nederlandse overheid naar diversiteit binnen haar organisatie. Of het nu gaat om de politie of het onderwijs, de waterschappen of de departementen, nagenoeg alle onderdelen van de publieke sector willen de verschillen benutten om de effectiviteit van de overheid te vergroten. De business case van diversiteit zit dus geworteld in het denken binnen de publieke sector. Vreemd genoeg wordt dit bewustzijn slechts in beperkte mate omgezet in interventies die bijdragen aan een overheid die adequaat maatschappelijke problemen kan oplossen. De uitdaging voor publieke organisaties ligt vooral in het duurzaam verbinden van de overheid met de samenleving. Sturen op verbinden kan het vertrouwen van burgers in de overheid vergroten. Dat kan bijvoorbeeld door zo goed mogelijk in het personeelsbestand een weerspiegeling te creëren van de samenleving. Maar zeker ook door de wisselwerking tussen de overheid en burgers, én binnen de overheid te stimuleren. Bovendien vergroten de juiste business case interventies de binding van medewerkers met de publieke organisaties. Transformationeel leiderschap en een inclusieve organisatiecultuur spelen daarbij een cruciale rol. Dit proefschrift toont aan dat sturen op verbinden de nieuwe route is voor de publieke sector. Show moreOp donderdag 16 september 1982 demonstreerden duizenden mensen op het Binnenhof in Den Haag toen Hans Janmaat beëdigd werd als lid van de Tweede Kamer voor de Centrumpartij (CP). Het bleef niet bij die ene demonstratie. Omdat ze scherpe kritiek had op het toenmalige immigratie- en integratiebeleid werd de CP vanaf de oprichting in 1980 fel bestreden. In de Tweede Kamer was er een cordon sanitaire; er werden rechtszaken aangespannen; antifascisten verstoorden partijvergaderingen; de media schreven negatief over de partij. En dat veranderde in de loop der jaren niet echt; voor de latere Centrumdemocraten (CD) gold in grote lijnen hetzelfde. In de ban van goed en fout beschrijft voor het eerst – op basis van archiefonderzoek en interviews – op samenhangende wijze de bestrijding van de CP en CD, en ook de reactie daarop van die partijen. Waarom werden ze zo fel werden bestreden? Werd de tegenstelling tussen die partijen en de rest van de samenleving vooral in morele termen gegoten? Was Nederland, kortom, in de ban van 'goed' en 'fout'? Show less

Show more De bestuursrechter wordt de laatste jaren steeds vaker geconfronteerd met geschillen over de verdeling van zogeheten ‘schaarse publieke rechten’. Schaarse publieke rechten zijn vergunningen, subsidies en andere publiekrechtelijke rechten waarvan de beschikbaarheid is beperkt door middel van een ‘plafond’ en waarnaar de vraag groter is dan het aanbod. Schaarse publieke rechten komen op uiteenlopende terreinen van het bestuursrecht voor. Enkele bekende voorbeelden van schaarse publieke rechten zijn: frequentievergunningen, kansspelvergunningen, concessies voor openbaar vervoer, NWO-subsidies en cultuursubsidies. De verdeling van schaarse publieke rechten op de verschillende bijzondere terreinen van het bestuursrecht roept vanuit het perspectief van het algemeen bestuursrecht gemeenschappelijke vragen op. In dit proefschrift staat een van deze gemeenschappelijke vragen centraal: de vraag of het bestuursprocesrecht van de Awb voldoende is toegesneden op de verdeling van schaarse publieke rechten. Uit het onderzoek zijn vijf knelpunten naar voren gekomen: ketenbesluitvorming, de noodzaak om meerdere besluiten aan te vechten, de geringe controleerbaarheid van de uitkomsten van het verdeelproces, de beperkte mogelijkheden tot materieel rechtsherstel en de geringe mogelijkheden tot schadevergoeding. In dit boek worden deze knelpunten beschreven en geanalyseerd en worden enkele oplossingsrichtingen verkend. Show more In this PhD-research, the main question addressed is whether or not conspiracy constructions are boosting hatred against the political system - and if conspiracy constructions could prompt violent actions against politicians, institutions or symbols of the political system. Based on research into digital communities in which conspiracy constructions flourish, the research concludes that conspiracy constructions function as substitute ideologies and substitute religions in a post-political setting. Offering a clear master narrative of 'Us' and 'Them', and making a complex world eligible again, conspiracy constructions function as coded social critiques informing those who feel alienated, neglected and betrayed by the political establishment. However, as conspiracy constructions neglect real social and political opposites, cleavages and antagonisms that divide each society and construct a fictitious homogeneous 'People', the political mobilizing potential of conspiracy constructions is almost absent. Notwithstanding the violent and hateful discourse on social media one should not exaggerate the risks in terms of national security. The popularity of conspiracy constructions and the hateful discourse against the political system signals foremost powerlessness, despair and resentment that finds an outlet on social media. Show moreDe Europese staatssteunregels stellen paal en perk aan de mogelijkheden voor lidstaten om ondernemingen financieel te steunen. Bij de handhaving van die regels komt een belangrijke taak toe aan de Europese Commissie en aan de nationale rechters. Deze rechters moeten de naleving van de besluiten van de Europese Commissie waarborgen, maar waar nodig ook zelf gevolgen verbinden aan een schending van de staatssteunregels. De Nederlandse rechter heeft zodoende bij de handhaving van de staatssteunregels op zijn minst op papier een belangrijke – en steeds belangrijker wordende – rol te vervullen. Daarbij moet hij niet alleen rekening houden met de relevante Europese regels, maar ook met de nationale (procedurele) context waarin hij opereert. Die kan nogal verschillen: zowel de burgerlijke rechter als de bestuurs- en belastingrechter kunnen namelijk met staatssteungeschillen worden geconfronteerd. In dit proefschrift wordt op basis van ruim tien jaar Nederlandse staatssteunrechtspraak geanalyseerd hoe deze rechters de hen toegewezen rol daadwerkelijk vervullen. Expliciete aandacht gaat uit naar de eisen die zij stellen aan het belang van de partijen, hoe zij beoordelen of van staatssteun sprake is, de gevolgen die zij daadwerkelijk aan schendingen van de staatssteunregels verbinden en de onderlinge verhouding tussen de Nederlandse rechter en de Europese Commissie. Show moreTussen hamer en aambeeld is a social economic study into several aspects of the goldsmiths profession in Friesland during the seventeenth century. The study, based on comprehensive research in archives, describes the influence of monetary laws, guilds and trade patterns on the lives and the works of the goldsmiths in Bolsward and Leeuwarden. During the Golden Age the craft was confronted with problems caused by the rigid monetary policy of the Frisian States. The Frisian goldsmiths became evermore depended on the import of silver from Amsterdam. The price of this silver rose while the selling price in Friesland remained fixed. In order to keep the profession exclusive the goldsmiths took protective measures and searched for creative solutions. Around 1672 many of the craftsmen were confronted with financial mishap. Some goldsmiths with a solid reputation, based on objects that survived the ages, set up a trade network with jewelers from Amsterdam. What are the consequences of this trade for the reputation of Frisian silver? The book contains biographies of the goldsmiths from Bolsward and new information about their marks. Show less

The man responsible throughout this period was Jacobus (Jac.) van der Kolk (1887-1980). Van der Kolk began his career in 1916 in the technical bookshop of Weduwe J. Ahrend & Zoon, a supplier of drafting and office equipment founded in 1896 by Jacobus Ahrend. Two years later he was promoted to head of Ahrend’s technical publishing department, which had been founded in 1904. In 1923 the Ahrend catalogue became that of Kosmos, with Van der Kolk being made director of the new firm.The research questions emerged after drawing up as complete a catalogue as possible. The subsequent analysis was aimed at gaining an understanding of Kosmos’s publishing programme, which aspects of it were stressed and how the various segments of the catalogue developed. The most important question, the one underlying this study as a whole, concerns the circumstances, working methods and decisions that produced the Kosmos catalogue in the years 1923-1960, and how Kosmos rated in the competition with other publishers operating in the same fields Show less

Als zoon van een raadsheer uit de Hoge Raad en neef van Anthonie Heinsius de raadpensionaris van Holland werd hij na zijn studie rechten in Leiden achtereenvolgens benoemd tot secretaris van de Generaliteitsrekenkamer, vanwege zijn aanleg voor financiële aangelegenheden in 1727 tot thesaurier-generaal van de Unie en in 1737 tot raadpensionaris van Holland. Hij had te maken met de ambitie van de Friese stadhouders, spanningen met Pruisen, met Frankrijk en met de erfopvolging van keizer Karel VI. Deze politieke biografie laat de worsteling zien van een raadpensionaris die beperkt was in zijn handelen door de slechte staat der financiën en gehinderd door binnenlandse tegenstellingen en tegenwerking. Essentially armor masks have a protective function and are, within the Japanese mask culture, the only masks which are not used for theater, dance or religious processions. The roots of menpō or “armor masks with facial features” are unknown, therefore, the subject is approached from the existing Japanese mask disciplines. The diversity and the connections with existing mask disciplines, especially nō masks, shows us that the Japanese armor masks form an integral part within the Japanese mask culture. This study provides new insights into the approach of form, function and meaning of the Japanese armor masks. Show less

Show more In recent decades, the Netherlands’ struggle with multiculturalism has caused an upsurge in public interest in the relationship between state and religion.The Dutch political tradition plays a central role in this book because the Netherlands developed a unique method of bridging seemingly irreconcilable religious differences: pacification. since the Batavian Revolution, the development of the Dutch state has been focused on democracy, upholding fundamental rights, and the separation of church and state that was supposed to turn the Netherlands into a religiously neutral state. In the second half of the twentieth century, the appearance of new religions on the Dutch stage, most notably Islam, has had a significant impact on the Netherlands’ national identity.the Dutch are now asking, should this religious friction be dealt with? How absolute is freedom of expression? Can religious ideas be criticized without restriction? The ability to deal with criticism is a crucial component of liberal democracy and freedom of speech. In die gevallen functioneert het aansprakelijkheidsrecht niet naar behoren en krijgen slachtoffers hun schade niet of pas veel later vergoed. De overheid gaat daarom in sommige gevallen over tot de oprichting van rampenfondsen. De auteur onderzoekt welke rol rampenfondsen in Nederland kunnen hebben bij de afwikkeling van rampschade in het aansprakelijkheidsrecht. Zij gebruikt daartoe het perspectief van het aansprakelijkheidsrecht en het Europees Verdrag voor de Rechten van de Mens. In dit verdrag vindt zij aanknopingspunten voor een plicht van de overheid tot oprichting van rampenfondsen. Het onderzoek mondt uit in aanbevelingen voor de inrichting van rampenfondsen gebaseerd op ervaringen met fondsen uit het verleden. Show moreThis study investigates the development between 1550 to 1630 of Southern Netherlandish animal imagery into an autonomous genre in relation to developments in natural history, networks of artists and scientists and elite collecting practices in order to gain insight into the production, function, and meaning of animal imagery. Before 1600 in Antwerp motifs circulated by means of an extensive network, through which animal drawings and print series flourished. Around 1600 in Prague a new medium blossomed: the exotic animal painting. With the new medium it appears that the circulation of motifs diminished and no new print series were published. Artists started studying animals from life in meangeries and naturalia collctions. The relation of the artworks to natural history also changed. Before 1600 artists copied motifs from illustrations in natural historical publications and paid much attentio to the order of the species. After 1600 artists strove to depict species that were not yet described and illustrated by natural historians and consequently contributed to and disseminated knowledge about these new species. Maar hoe zou de rechter de relativiteit van een wettelijke norm moeten vaststellen? Dit proefschrift is een poging een samenhangende visie te ontwikkelen op de definitie en ratio van het relativiteitsvereiste en de toets aan dit vereiste bij wettelijke normen. Sluitstuk van deze visie is een model voor deze toets. Daarin staat het institutionele perspectief van de legitimiteit van het relativiteitsoordeel in het licht van de verhouding van de rechter tot de wetgever voorop. Aan de vraag in welke gevallen de rechter zou moeten oordelen dat wel of juist niet aan het relativiteitsvereiste is voldaan, gaat immers de vraag vooraf of en in hoeverre het aan hem is om dat te bepalen of aan de wetgever. Met dit model als ijkpunt wordt vervolgens onderzocht of de kritiek in de literatuur op de rechtspraak van de Hoge Raad terecht is en deze bijstelling behoeft, of dat de rechter juist doet wat van hem mag worden verwacht. Show more During the Second World War the Dutch government in exile in London had enacted Decrees under Subjective (unwritten) State Emergency Law. In 1943 and 1944 a set of Decrees were established to be able to sentence people who had committed war related crimes, international war crimes or had collaborated with the German occupiers of the Netherlands. Special Criminal Courts and a Special Court of Cassation were to be installed to sentence war related crimes and international war crimes. By the beginning of 1946 all chambers were functioning. In this study all the sentences by the Groningen Chamber of the Special Court Leeuwarden and Cassation of the Groningen cases are analysed and valued Apart from the analysis and valuation of the sentences of the Groningen all the Decrees on special jurisdiction and the related Acts, Laws and Decrees are described. Furthermore, all the actors in the Special jurisdiction are extensively described. The conclusion of this study is that the Chamber Groningen and the Special Court of Cassation have sentenced fairly and the sentences were proportionate. In view of the problems identified in this study it would be wise to examine the current acts on state emergency and punishment after a war. Show less
