Show moreCuraçao is an autonomous country within the Kingdom of the Netherlands and has just one single tax treaty for the prevention of double taxation, namely with Norway. Curaçao has proven unsuccessful in the conclusion and ratification of full tax treaties. Until now, little attention has been paid to the underlying reasons why Curaçao has proven unsuccessful in building a tax treaty network. The central research question is: “How should Curaçao design its tax treaty policy in order to build a tax treaty network?” This study does not aim to provide recommendations on the technical aspects of a tax treaty policy or a model convention. Rather, the objective of this study is to identify the conditions for building a tax treaty network.The research identifies the obstacles for Curaçao to conclude (and ratify) tax treaties. Furthermore, the research shows which considerations are relevant for Curaçao to build a tax treaty network. The outcome of this research is an evaluation framework that can act as a guide for Curaçao when designing a tax treaty policy or adjusting a potentially existing (but unpublished) tax treaty policy. Fiscale geheimhouding vindt haar oorsprong in de Wet VB 1892, maar blijft onverminderd actueel. De uitgangspunten van geheimhouding staan echter al decennialang onder druk door toenemende (internationale) gegevensuitwisseling als gevolg van een soms ongebreidelde drang om misbruik of oneigenlijk gebruik van overheidsregelingen, fraude, belastingontduiking of belastingontwijking aan te pakken. In dit proefschrift wordt antwoord gegeven op de vraag of de huidige fiscale geheimhoudingsbepaling nog aan de oorspronkelijke doelstellingen voldoet of dat aanpassingen wenselijk of noodzakelijk zijn.Aan de hand van vijf relevante elementen (doelstellingen, onderworpen subjecten, object van geheimhouding, fiscale afbakening en de uitzonderingen & ontheffingen) is de fiscale geheimhoudingsverplichting uitputtend geanalyseerd. Hieruit volgt onder andere:• voor de fiscaliteit zou art. 2:5 Awb niet volstaan;• het opleggen van geheimhouding bij derdenonderzoeken door de inspecteur kan nu niet. Voorgesteld wordt een tijdelijke geheimhoudingsverplichting bij een zwaarwegend controle-strategisch belang;• voorgesteld wordt om aan alle afnemers van fiscale informatie (bestuursorganen en private partijen) geheimhouding op te leggen;• ook op niet-herleidbare gegevens rust een geheimhoudingsverplichting. Voorgesteld wordt dit aan te passen;• de vooringevulde aangifte (VIA) en de inkomensverklaring (IB60) ontberen een wettelijke grondslag. Voorgesteld wordt dit aan te passen;• uitzonderingen en ontheffingen vergen een continue belangenafweging. De Staatsecretaris van Financiën laat hier echter steken vallen;• informatieverstrekking aan betrokkenen zelf dient – ter verbetering van de rechtsbescherming – vergaand te worden verruimd;• bij een zich repeterende casus is geen sprake van een incidenteel of onvoorzien geval waarvoor een ontheffing door de Staatsecretaris van Financiën kan worden verleend. At the same time, it is not always clear on the basis of which rules, and in what way, this factor has significance in the tax legislative process. This information gap may hinder parliament's role as a tax co-legislator.Understanding and overview of the budgetary impact of (a part of) a tax bill is indispensable to show meaningful parliamentary involvement in the adoption of a tax law. Only then will parliament, as a tax co-legislator, be able to form a stand-alone position on proposed tax legislation, have the real opportunity to make adjustments to it and control the budgetary impact.The cabinet has an (active) obligation to inform individual MPs. However, parliament often does not appear to be adequately informed about the budgetary impact of tax legislation. In that case, there is no meaningful parliamentary involvement in the adoption of the tax law, which also involves the legitimacy of taxation.This thesis focuses on when and why, according to parliament, the budgetary information provision is not sufficient for the tasks as a tax co-legislator. Proposals to improve this information provision are also being put forward. Show less

Extensive research led to the development of a general norm theory based on norm definitions that allowed for the formulation of a coherent set of legal norms, thus distinguishing between different norms. Consequently, this set is constitutive for the construction of an executable legal system which is demonstrated by applying the theory on the Dutch tax system. The general formula of a norm is given by ∀ε∈E 'imperatief^'φ, in which φ represents in algorithmic form the most recent content. This symbolic form represents all the properties of a norm and may include existing norm theories. Furthermore, it is demonstrated that every legal text can be transformed into this algorithmic form. This requirement is particularly important for legislation that has financial consequences for citizens, such as tax legislation. The objective of this research is to provide an overview of the way in which the requirement of clarity regarding tax legislation has been filled in by the literature, by case law and by organizations working in the field of legislative advice. Based on the results of this research, the criteria that have to be applied to tax legislation can be categorized as conditions concerning i) the formulation of legislation, ii) the structure of a legal system, iii) the status of persons at whom legislation is adressed to and iv) the way in which the relevant rules are explained. Show moreIn dit proefschrift is onderzocht hoe in de jaarrekening wordt omgegaan met onzekere risico’s in verband met claims, juridische geschillen en rechtsgedingen als voorbeeld van contingencies. Deze geschillen vragen van de aangesproken vennootschap voortdurende schatting van de proceskans en van de mogelijke financiële gevolgen. Het is afhankelijk van deze schattingen of een voorziening in de jaarrekening moet worden verwerkt (recognition), wat de omvang daarvan dient te zijn en/of welke informatie moet worden gegeven om te voldoen aan het inzichtvereiste van de jaarrekening (disclosure). Schattingen vormen zo een belangrijk subjectief element in de jaarrekening. In eerdere onderzoeken zijn aanwijzingen gevonden dat van winststuring sprake kan zijn bij beslissingen om een voorziening te vormen. In IAS 37 zijn daarom specifieke voorschriften opgenomen met betrekking tot geschillen in de jaarrekening om winststuring te bestrijden. Aan de hand van jaarrekeningenonderzoek onder vennootschappen waarvan de aandelen aan de AEX/AMX zijn genoteerd is de mate van compliance onderzocht. In hoeverre voldoen de jaarrekeningen aan de gestelde eisen met betrekking tot de verwerking en vermelding van claims, juridische geschillen en rechtsgedingen. Tevens is onderzoek gedaan naar de mogelijke invloed van het jaarrekeningenrecht op fiscale grondslagen en andersom van fiscale grondslagen op het jaarrekeningenrecht en naar de wenselijkheid daarvan. Show moreThe key objective of this research is to design a consultation model for the legislative process in fiscal matters. When tax laws are being drafted, such a model can be used as a tool to select the best possible consultation variant and the suitable stakeholders. I have analyzed six consultation methods with the aim of providing a framework for selecting the most effective one(s). I have described the structure and possible variants of each of these six methods and I have explained their strengths and weaknesses. Of fiscal stakeholder groups that may be consulted there are seven: taxpayers; tax consultants and their professional organizations; interest groups; academics; judges and the National Ombudsman; foreign authorities; and internal stakeholders. I have identified the consultation purposes to which the various stakeholder groups can usefully contribute as well as the considerations underlying the choice whether or not to consult a particular stakeholder group. As the manner in which a consultation procedure is executed can be a decisive success factor, the key stages of a sound consultation procedure and the considerations underlying them are also an integral part of this research. Show moreDe schuldenproblematiek in Nederland is nog steeds groeiende. De impact op de schuldenaar, maar ook op de samenleving, is groot. Financiële problemen zijn voor een groot deel een gedragsvraagstuk. In deze dissertatie staat het gedrag van de groep consumenten met een financiële achterstand centraal. Uit de analyses blijkt dat het niet één specifieke gedraging is die leidt tot financiële problemen, maar een combinatie van verschillende gedragingen die het risico op financiële problemen vergroten. Zo spelen niet bijhouden van de administratie, post en niet vooruit plannen een rol. Analyses naar de oorzaken van deze gedragingen laten bovendien zien dat er verschillende factoren en processen zijn die samenhang vertonen met het financiële gedrag. Onder meer de rol van self-efficacy, self-control en sociale steun, is onderzocht en blijken een samenhang te hebben. Financiële problemen kennen een eigen dynamiek. Eenmaal geconfronteerd met financiële problemen, verandert het gedrag van de consument. Deze verandering wordt deels veroorzaakt, doordat hij zich moet aanpassen en bijvoorbeeld meer gaat bezuinigen. Maar de verandering van gedrag is ook het gevolg van processen zoals schaarste en een veranderende houding ten opzichte van schulden. Show less

Show moreHet Nederlandse arbeidsongeschiktheidsstelsel bestaat uit wettelijke regelingen, zoals de loondoorbetaling bij ziekte op grond van het Burgerlijk Wetboek en de Wet Werk en inkomen naar arbeidsvermogen, én uit cao-regelingen die een bovenwettelijke aanvulling verstrekken. De laatste dertig jaar zijn de wettelijke regelingen vaak en grondig herzien. In reactie daarop hebben sociale partners hun cao-regelingen aangepast. In deze studie worden de belangrijkste wijzigingen onderzocht die zich tussen 1980 en 2010 hebben voorgedaan in de personele en materiële werkingssfeer, de financiering en de uitvoering van de hiervoor bedoelde regelingen. Daarbij staat de vraag centraal hoe die wijzigingen en de daaraan ten grondslag liggende overwegingen, kunnen worden gewaardeerd. Dat geschiedt op basis van vijf criteria: mate van keuzevrijheid, mate van inkomensbescherming, mate van solidariteit, aantal arbeidsongeschikten en totale kosten. Verder wordt onderzocht welke alternatieven er bestaan voor het huidige arbeidsongeschiktheidsstelsel. Ook die alternatieven worden gewaardeerd op basis van de vijf hiervoor genoemde criteria. Op deze manier wordt de bestaande kennis over de grondslagen van het huidige arbeidsongeschiktheidsstelsel verdiept. Waarom is het stelsel ingericht zoals het is ingericht? Wat zijn de voor- en nadelen van dit stelsel? Meer concreet wordt ingegaan op de noodzaak of wenselijkheid van een verzekeringsplicht voor werknemers, de optimale verhouding tussen publieke en private inkomensbescherming, de spanning tussen rechtvaardigheid en doelmatigheid bij de financiering van de uitkeringslasten, de effectiviteit van financiële prikkels en de doelmatigheid van de uitvoering. Show moreThe research focuses on the various procedures for transfer pricing dispute resolution existing at an international level between states and taxpayers. These procedures are the advance pricing agreement procedure, the mutual agreement procedure and the arbitration procedure. The objective of the research is to determine to what extent the current transfer pricing procedures provide a fair and also sufficiently efficient and effective framework for the resolution of cross-border transfer pricing disputes. The answer to the central question will be based on an evaluation of the dispute resolution framework against the higher national and international standards of fair trial and on stocktaking research (i) into the results acquired with the procedures at national and international level, (ii) into the present national and international legal basis for its implementation, and (iii) into the changes in the procedures that were over the years introduced. Next, the study identifies the main issues in the dispute resolution framework paying equal attention to each of the transfer pricing procedures. Finally, the study offers recommendations that can solve the identified issues and that can, in particular, create a framework for the resolving cross-border transfer pricing disputes that responds better to the criteria of fairness, efficiency and effectiveness. Show moreDe fiscale beleidsvrijheid van EU-landen is de afgelopen jaren flink ingeperkt en met dit onderzoek wordt duidelijk gemaakt hoe moet worden beoordeeld of de wetgever binnen de grenzen van het EU-recht is gebleven. Daarnaast wordt onderzocht in hoeverre de soms forse kritiek op het Europese Hof terecht is. De conclusie is dat deze kritiek niet geheel terecht lijkt. Het onderzoek heeft geresulteerd in een toetsingsmodel aan de hand waarvan kan worden beoordeeld hoe de tegengestelde uitgangspunten van nationale fiscale soevereiniteit en het Europese vrije verkeer met elkaar moeten worden verzoend. Aangezien onverkorte uitvoering van één van beide beginselen zou leiden tot de non-existentie van het andere beginsel, moet het conflict tussen beide beginselen worden opgelost in een optimaliseringsproces. Waar ligt het punt waar beide beginselen zoveel mogelijk tot hun recht komen? Het model maakt het mogelijk op meer gefundeerde en gestructureerde wijze kritiek op het Hof te leveren. This study takes the proper explanation of the concept of value, as derived from the economists belonging to the Austrian School of Economics, as a starting point. During the last decades a mainstream approach to business valuation developed. This study treats the question whether this mainstream approach is based on the ideas about value which developed in the Austrian School of Economics. If so, how? If not, is it possible to derive insights from the Austrian School in order to improve the way we value in daily life?Businesses are capital goods and these are pivotal in creating wealth. Based on the Austrian perspective only real savings can lead to the existence of capital goods. The real world is not like most textbook models featuring a circular flow. Man is able to create value and obtain a higher level of wealth. As an important sidestep a flow model, based on a so-called Petrinet, was constructed to show the growth creating character of capital goods. In order to investigate the way mainstream economists and practioners determine economic value a framework was developed to structure both the theoretical approach and everyday practice. Two illustrative examples demonstrate how to calculate economic value based on Austrian principles. Exemptions or deductible items applicable today might be abolished next year. The legislator faces two questions with each legislative amendment: when to enact new rules, and whether they should apply to everybody or whether exceptions should apply in certain cases. Miscellaneous factors affect the solution to these questions. A major factor is the trust that civilians may have as regards the continuance of the former rule. Another regards the taxpayers’ reaction to the announcement of a legislative amendment. To date, the factors affecting aforementioned decisions have not yet been systematically listed. The goal of this research is to develop a framework for fiscal transition policy. Firstly, the framework comprises an assessment framework for fiscal transitional law. The assessment framework provides concrete guidelines for both drafting transitional law and assessing existing transitional regimes. It is a product of the framework for fiscal transition policy, as it incorporates both the policy-related actions of the legislator and taxpayers’ behaviour. Secondly, the framework contains rules of thumb for the legislator for pursuing a fiscal transition policy. Show less
