Show moreThis paper argues that pastoral commons are under increasing pressure not just from overuse by pastoralists themselves, but from land management policies. Since colonial times, these have been based on a persistent misconception of the nature of pastoral economies and combined with increasing land alienation and fragmentation through government policies and covert privatisation of pastures. The paper focuses especially on pastoral populations in African drylands and is based on long-term research by independent researchers summarising some of their experiences in western, eastern and southern Africa. Most of them are organised in the African Drylands Dialogue, trying to shed some light on the developments in these areas. Before discussing the actual situation of African pastoralists, the authors focus on basic institutional features of the political and economic management of common grazing lands. This is followed by an overview of land alienation processes in colonial times, which serves as a basis for understanding the current land alienation constellations. The paper then moves on to explain how and why pastoralists are framed by the national discourses as the 'other' and the 'troublemaker', even being labelled as terrorists in nation state contexts. This goes hand in hand with a new wave of land alienation in the form of large-scale land acquisitions or 'land grabbing' (including water grabbing and 'green grabbing' processes). The paper then outlines different coping and adaptation strategies adopted by pastoral groups in a context in which a range of different global and local political, economic and ecological situations interrelate ('glocal'). Show moreAccess to land is increasingly becoming a problem in Africa as a result both of population growth and tenure reforms. The standard argument for tenure reform centres on the role of uncertainty in discouraging investment on land held without long-term security. The rationale for this 'replacement' paradigm, however, can be questioned on economic, ecological and social grounds. The history of land tenure reform in Kenya, especially that of group titles in the semiarid areas, is a case in point. The Maasai pastoralists, in particular, have lost huge amounts of land, first to the Boers and other white settlers under colonialism, and now they face an influx of agricultural groups and large-scale capitalist farmers following the individualization of land held under statutory group title in the wake of the failure of the group ranches introduced in the late 1960s. The commoditization of land and the creation of a land market have led to a rapidly growing stratification in the Maasai area. A number of lessons can be drawn from the Kenyan experience, in particular of group tenure, for land reform policy in postapartheid South Africa, viz. interventions should build on local land tenure practices; group titles can be instrumental in assisting large groups of less well-off people; and movement toward individual tenure reform should be initiated only when technical and socioeconomic conditions warrant it. Show moreDans cet article l'auteur explore les possibilités et les limites d'une loi foncière pour résoudre les problèmes fonciers constatés dans une société donnée. Après avoir dénoncé l'approche instrumentaliste en matière législative, qui consiste à croire qu'il suffit d'adopter une loi 'moderne' pour que soient résolus les problèmes, l'auteur préconise l'adoption d'une approche sociologique par le législateur, qui devra accepter qu'une réforme foncière s'adresse à une société pluraliste. Deux exemples de pratiques foncières 'à l'ombre du droit' à Ziguinchor, une ville secondaire du Sénégal, observées dans les années 1980, illustrent ses propos. Ces exemples montrent que les citadins savent que les 'lois du village' ne sont plus adaptées à un contexte de changements rapides, et qu'un tel système de règles doit être trouvé auprès de l'État. Aussi sont-ils prêts à reconnaître l'État, mais si possible à leur propre manière, c'est-à-dire 'à l'ombre de la loi'. Simultanément, certaines notions foncières appartenant au système foncier traditionnel continuent à être appliquées. A partir de ces exemples, l'auteur fait quelques recommendations concernant de possibles réformes foncières, qui devraient aller à la recherche de solutions originales, plus près des pratiques locales. La réforme a pour but la mise en valeur accélérée de la terre afin d'augmenter la production alimentaire du pays. La région du Trarza-Est, dans la vallée du fleuve Sénégal a été choisie par les autorités mauritaniennes comme zone expérimentale. Un ensemble d'observations de première main, difficilement accessibles en raison des tensions foncières, politiques et ethniques qui règnent dans la région du Trarza-Est, ont été réunies par les auteurs lors d'une mission d'évaluation effectuée en 1992 et organisée par la Banque mondiale et les autorités mauritaniennes: elles permettent de mieux comprendre le contexte, l'origine et les raisons des conflits constatés. Show moreAnalyse, basée sur une recherche effectuée en 1982 et 1983 en Basse-Casamance, région située dans le sud-ouest du Sénégal, de la manière dont l'Etat sénégalais utilise la législation en matière foncière pour tenter de parvenir au niveau local le plus bas, celui du simple paysan. Après un aperçu de l'évolution du droit foncier à l'époque coloniale, l'auteur décrit dans les grandes lignes la réforme foncière de 1964 et la réforme administrative de 1972. Elle étudie certains effets secondaires de la réforme foncière, effets importants au niveau de l'encadrement croissant de la vie rurale par l'Etat, et elle montre que le Sénégal connaît toujours une situation de pluralisme juridique. Néanmoins la nouvelle législation se traduit par un 'consensus' provisoire, tacite et partiellement dissimulé entre les pouvoirs publics et les paysans. Show less
