Show moreIn this article we examine whether the proposal to criminalize illegal stay in the Netherlands was preceded by increased negative media attention for unauthorized immigrants. Using a corpus linguistics approach, we carried out a quantitative discourse analysis of all newspaper articles on unauthorized migrants over a period of 15 years. Our results show that the amount of media coverage actually strongly decreased in the years before the proposal, and this coverage was moreover increasingly less negative. This study thus nuances the somewhat popular belief that unauthorized migrants are increasingly portrayed in negative ways and shows that the framing of migrants as criminals is a more diffuse process in which the media seem to follow rather than fuel politics and policy. De acceptatie van en het geloof in een multi-etnische samenleving die gaandeweg leek toe te nemen, kreeg een sterke knauw rond de millenniumwisseling. Momenteel is het beeld verre van eenduidig. Enerzijds is de multi-etnische samenleving allang een feit, zeker in de grote steden, anderzijds is er een voortdurend ongemak over migratie en integratie en alles wat daarmee samenhangt, zowel in het politieke als in het bredere maatschappelijke debat. Migratie is daarmee een complex thema dat veel emoties oproept. De laatste jaren wordt onder andere door de sterke stijging van het aantal asielzoekers vaak gesproken van een migratiecrisis en is ook de link naar binnenlandse veiligheid steeds zichtbaarder. This article not only shedslight on the understudied area of border policing, it also aims to give insightinto the broader context that might influence the street-level decision-making ofDutch Border police officers. By means of a discourse analysis of over 250documents, the research shows how the social surround and the decision fieldof border security in the Netherlands develops over a period of 20 years. Theresults of the study not only show how Dutch border security is increasinglydirected at the criminal immigrant, but also the increased use of and belief inintelligence-based and technology-driven decision-making. It addresses questions which not only enhance our understanding of how Islamic courts in Indonesia work, but also of how Islamic courts through their everyday adjudication processes have the potential to transform societal norms based in national family law, Islamic law and customary law. What is the history of the Islamic courts in both districts and what are its consequences for their position in the local community? What role do the Islamic courts play in protecting women’s divorce rights? How do they perform with regard to spousal support, child support and marital property and why? How do the Islamic courts treat women’s and men’s claims? How has Indonesian family law for Muslims developed and what is the role of the Islamic courts in this development? How are Islamic courts positioned in Indonesia’s nation-building project? Show moreThe ECtHR needs to provide effective rights protection, but it also needs to set clear standards while showing deference to decisions made at the national level. Especially when socio-economic issues are concerned, meeting these different demands is a challenging task. The thesis explores the possible use and added value of the notion of ‘core rights’ for the reasoning of the ECtHR in socio-economic cases. By means of a comparative study of the German Wesensgehaltsgarantie, the minimum core obligations related to the ICESCR, and the debate on the use of core rights for the protection of socio-economic rights under the South African Constitution, insights are gained on the possibilities and pitfalls inherent in this idea. On the basis thereof, a ‘core rights perspective’ is outlined that is tailored to the protection of socio-economic interests by the ECtHR. It is argued that this perspective allows the ECtHR to develop a principled approach to (positive) socio-economic claims that is characterised by a clear demarcation of the scope of the Convention and a focus on minimum guarantees. In this way the core rights perspective may help the ECtHR in leaving the necessary room for national laws and policies while ensuring robust socio-economic protection. Show less

Show moreWhen investigating serious violence, studies tend to look primarily at offenders and their background. This study investigates the influence of offenders’ and victims’ criminal history and immediate situational factors on the likelihood that violent events will end lethally. For this purpose, we compare lethal with non-lethal events, and combine Dutch criminal records with data from court files of those involved in lethal (i.e., homicide, n = 126) versus non-lethal events (i.e., attempted homicide, n = 141). Results reveal that both criminal history and immediate situational factors clearly matter for the outcome of violent events; however, immediate situational factors have the strongest effect on violent outcomes. Show moreDo Member States of the EU have a free hand in drafting Accession Treaties, or are there legal constraints on their primary law making function in this context? That is the central question this thesis addresses. It argues that such constraints do exist, and tries to identify them, thereby hoping to provide some insight into the nature of the EU legal order. The point of departure as well as the main focus of the study is the proposed permanent safeguard clause (PSC) on free movement of persons in the Negotiating Framework for Turkey. It is with reference to the PSC that legal provisions, rules, principles and norms that might constrain Member States as primary law makers in the context of accession are identified. The thesis examines constraints on Member States flowing from three levels: the pre-accession level, that is the existing legal framework around the EEC-Turkey Association Agreement (Part I); the accession process level, which is comprised of past practice and existing EU rules on enlargement (Part II); last but not least, the constitutional foundations of the Union (Part III), which constrain Member States whenever they act within the scope of Union law both as primary and secondary law makers. Show moreAls een bestuursorgaan een maximum stelt aan het aantal vergunningen, ontheffingen of concessies dat verleend kan worden of het beschikbare subsidiebedrag beperkt, is sprake van een schaars besluit. Door een dergelijk plafond kan de situatie ontstaan dat er meer aanvragers zijn dan beschikbare besluiten. Hoe moeten deze besluiten in dat geval worden verdeeld? Welke rechtsnormen moeten bij de verdeling in acht worden genomen? Centraal in dit onderzoek staat één van de rechtsnormen die bij de verdeling van schaarse besluiten in acht moet worden genomen: de transparantieverplichting. Door bepaalde transparantievereisten in acht te nemen, stellen bestuursorganen alle potentieel geïnteresseerde partijen in staat om een aanvraag voor een schaars besluit in te dienen. De transparantieverplichting draagt hiermee bij aan de gelijke behandeling van de aanvragers. In dit boek wordt onderzocht in hoeverre de transparantieverplichting bij de verdeling van schaarse rechten in het bestuursrecht in acht zou moeten worden genomen. De belangrijkste conclusie van het onderzoek is dat de transparantieverplichting een toegevoegde waarde heeft voor het Nederlandse bestuursrecht, gelet op de gewenste gelijke behandeling van geïnteresseerde partijen bij de verdeling van schaarse besluiten. Daarom zou de transparantieverplichting als onderdeel van het gelijkheidsbeginsel bij schaarse besluitvorming in acht moeten worden genomen. Show less
