Show moreThis thesis explores the application of the United Nations Convention on the Rights of the Child, 1989 (‘the CRC’) by domestic courts, in the light of the formal domestic rules which govern the relationship between international treaties and domestic law. The focus is on three legal systems – Australia, France and South Africa – purposefully selected to represent three different reception models: dualist, monist and hybrid respectively. The thesis demonstrates that the formal rules of reception are only a starting point for the courts, but do not always explain why, how and with what consequences the courts have given effect to the CRC. The courts have applied the CRC creatively, building on the strengths of their respective systems and sometimes compensating for potential vulnerabilities in the domestic reception framework. The thesis calls for, inter alia, a recognition of the complex position of the courts at the intersection between domestic and international law; and for a closer exploration of the added value of the Convention in relation to other legal instruments. It also encourages a dialogue between the CRC Committee and the courts in relation to the interpretation of the CRC. Show less

Show moreOp 28 juni 2019 schreef minister voor Rechtsbescherming Sander Dekker een brief aan de Tweede Kamer over de aanpak van de jeugdcriminaliteit. Hij constateert dat de daling van jeugdcriminaliteit doorzet maar afvlakt en dat de recidive toeneemt. Volgens de minister krijgen jongeren nog niet altijd de straf, interventie of behandeling die het beste aansluit opde ernst van het delict en de risicofactoren voor herhaling. Daarnaast kent het jeugdstrafrecht slechts één type justitiële jeugdinrichtingen, terwijl de groep jongeren die met het strafrecht in aanraking komt, divers is en verschillende behoeften heeft. Dit betekent dat het wenselijk is om een stelsel te creëren waarbij een jeugdige in een kleinschalige voorziening dan wel in een landelijke specialistische voorziening geplaatst kan worden. In dit artikel bespreek ik de ontstaansgeschiedenis van de Kleinschalige Voorziening (KV), de ervaringen met plaatsing in de KV’s en juridische en praktische uitdagingen. Show less

Empirical research findings are used to identify patterns and functions of pre-trial detention in the administration of youth justice. In addition, two driving forces behind pre-trial detention decision-making are explored after scrutinizing the penological underpinnings of youth justice and youth crime control in Western societies. Ultimately, the article addresses to what extent and how international children’s rights standards can effectively protect child suspects and accused from excessive, unlawful and arbitrary pre-trial detention. Show moreDiscussing legal issues related to smart contracts on the blockchain is very topical. This article will discuss primarily smart contracts on the blockchain the conclusion and execution of which does not interact with the physical world, as well as briefly touch upon smart contracts on the blockchain which do interact with the physical world. For these smart contracts, it will be determined to what extent existing EU internet laws can help support their development and if not, what is needed to support this. In order to answer this question, the following will be discussed: the rise of e-commerce and in particular the EU internet laws supporting and regulating e-commerce, how smart contracts work and how smart contracts compare with existing technological developments and comparable legal constructs (internet, bank accounts and bank guarantees). Subsequently, it will be explained how the use of smart contracts leads to a shift of confidence, from trust in people to trust in code. On the basis of The DAO hack and the problems that arose, it will be illustrated that this shift to trust in code is not as absolute as is often thought. The article concludes that applying specific EU laws on supporting and regulating e-commerce to smart contracts is difficult for two reasons. First of all, the starting points differ: trust in people versus trust in code. Secondly, technical and practical obstacles often inhibit applying internet laws in a meaningful manner. When using smart contracts, it makes more sense to prevent problems from arising than to correct them afterwards. For this reason, it is advocated that programmers work together with lawyers to create better smart contracts and that the legislator focuses on laws dealing with auditing smart contracts code by trusted third parties and automatically equating smart contracts with written contracts with wet ink signatures. This will hopefully facilitate the rise of smart contracts on the blockchain. Show less

Show moreThe establishment of harmonized bank resolution frameworks was a fundamental element of the reforms undertaken in the EU in response to bank failures during the latest financial crisis. The frameworks empower authorities to intervene in failing banks as an alternative to the opening of an insolvency procedure to protect financial stability and minimize the costs for taxpayers. The fact that national insolvency laws play an essential role in the bank resolution regimes but have not been fully harmonized in the EU, is likely to be a source of complexity and legal uncertainty in cross-border resolution procedures.This book investigates the bank resolution regimes in the Netherlands, Germany and the UK. It analyzes how the national frameworks interact with and have been embedded into Dutch, German and English private law, including insolvency law. The study shows that the frameworks deal with specific topics and objectives and contain rules and terminology that are different from those in existing national legislation. It also shows which differences may exist between the bank resolution procedures in the three jurisdictions. The study makes an important contribution to the existing debate about the further development of the EU bank insolvency framework. Show less

Show moreIn dit onderzoek staat de vraag centraal wat het beginsel inhoudt, dat niemand ten koste van een ander ongerechtvaardigd mag worden verrijkt en hoe dit beginsel tot uitdrukking komt in het systeem van het vermogensrecht. Betoogd wordt dat het verrijkingsbeginsel in verschillende vermogensrechtelijke regels tot zijn recht komt en dat de algemene verrijkingsactie vooral een aanvullende functie heeft om onvoorziene verrijkingsgevallen tot een oplossing te brengen. Een belangrijk deel van het onderzoek draait om de vraag wat de aanvullende functie met zich brengt voor de invulling van de toepassingsvereisten van de algemene verrijkingsactie. Een belangrijke bevinding is dat de figuur van de ongerechtvaardigde verrijking niet teveel a priori moet worden beknot. Zo wordt betoogd dat aansprakelijkheid op grond van ongerechtvaardigde verrijking onder omstandigheden een alternatief kan bieden als aansprakelijkheid op grond van overeenkomst of onrechtmatige daad niet haalbaar of twijfelachtig is. Show moreDe overheid mag kinderen onder voorwaarden van hun vrijheid beroven met als doel ze op te voeden en te beschermen. In de Nederlandse context wordt deze vorm van vrijheidsberoving ‘gesloten jeugdhulp’ genoemd, geregeld in de Jeugdwet. Met dit onderzoek is beoogd om een kinder- en mensenrechtentoetsingskader op te stellen, waaraan de Nederlandse wet en de toepassing getoetst wordt. Tevens biedt het onderzoek inzicht in 200 jaar historie.Verder zijn 586 rechterlijke uitspraken over een periode van 10 jaar (2008-2017) geanalyseerd. Hieruit blijkt dat een plaatsing vaak gebaseerd is op het inzetten van acute hulp in een situatie waar in niets anders mogelijk lijkt te zijn. Doorgaans wordt daarbij onvoldoende gekeken naar het doel van deze plaatsing en de vrijheidsbeperkingen die dit met zich meebrengt.In dit onderzoek komen ten slotte 23 kinderen aan het woord die te maken kregen met een gesloten uithuisplaatsing. Uit het onderzoek blijkt dat de legitimiteit van het op grote schaal toepassen van deze maatregel onder druk staat, met name omdat het nogal eens ontbreekt aan passende zorg. Verschillende aanbevelingen worden gedaan om de legitimiteit te verbeteren, onder meer door middel van verdieping van het juridische toetsingskader, verkorting van de maximale duur van een plaatsing.
