Show moreIn its 2019 report to the Human Rights Council, the United Nations (UN) Working Group on business and human rights emphasized that ‘gender-transformative’ remedies can bring ‘change to patriarchal norms and unequal power relations that underpin discrimination, gender-based violence and gender stereotyping’. This article aims to deepen our knowledge of such remediation for women human rights defenders who fight against corporate human rights abuses. Human rights remediation is highly fragmented. This has the advantage that remedies at one level can offer sources of learning for remedies at other levels. This article uses relevant communications that the UN Special Rapporteur on the situation of human rights defenders sent to states and corporations jointly with other Special Procedures (including the UN Special Rapporteur on violence against women and girls, its causes and consequences and the UN Working Group on discrimination against women and girls in law and practice) between 2011 and 2020 as a source of learning. Show moreThis dissertation is about intra-EU workers and labour law related (bogus) constructions under which they work in the Netherlands and other EU member states.Through the following two main research questions this situation is outlined and analysed.1. To what extent do intra-EU workers in the Netherlands work under labour law related (bogus) constructions that (financially) disadvantage them?2. What are the perceptions of intra-EU workers regarding the use of labour law related (bogus) constructions and their working conditions and circumstances under which they work in the Netherlands and other EU member states?In each chapter of this thesis, these questions are elaborated into more specific research questions.In this research both legal and empirical research that fits within the Empirical Legal Studies (ELS) framework is conducted. Through this combination of research methods it was viable to link the collected empirical (interview) data to the legal data based on literature and case law research. Hence, the theory (law in books) was tested against facts and observations (law in action). Moreover, by establishing this link the present research adds a new and valuable dimension to current academic legal and social scientific research. Show less

Show moreThis article discusses the European Commission’s proposal for a regulation to ban products from forced labour inthe European Union (EU) of September 2022. It argues that the Commission failed to conduct an impact assessmentwhich could have addressed gender dimensions. This was omitted because the proposal would be ‘urgent’. While not atypical — the EU has often turned a blind eye to women’s issues — the gender-blind nature of the proposal is unfortunate. At least three indicators of forced labour that are used by the International Labour Organization — including the two most common indicators vulnerability and wage non-payment — have a differentiated impact on women. Drawing from the three-step framework in the Gender Guidance of the United Nations Working Group on Business and Human Rights, this article suggests a way to start discussions to include a gender perspective in the regulation. Show moreSexual exploitation of children in the context of travel and tourism (SECTT) has been described as a serious and growing problem. This study critically analyzes political debates and policy measures proposed by the Dutch government between 1995 and 2020 to combat SECTT. To understand how SECTT is framed in Dutch political discourse, Bacchi's ‘what's the problem represented to be?’ approach guided a systematic critical discourse analysis of over 200 political documents. Our analysis shows that SECTT has, over time, predominantly become framed as a crime problem. Offender detection, international cooperation, awareness raising, public–private partnerships, and prevention targeted at known sex offenders are the most commonly proposed solutions. Despite the focus on apprehending offenders, the political discourse offers no concrete clues as to who they are; still, conducting research or evaluating policies' effects is seldom proposed as a response. This problem representation overlooks the connections of SECTT with structural issues, such as victim vulnerabilities, colonization, and global inequality on the one hand, and mental health, sexual expression, and cultural values on the other. Show moreAbstract: Background: Radicalization, violent extremism, and terrorism are risks to societal security. Although research on terrorism-related behaviors is increasing, thorough empirical studies are rare. Methods: This study investigates radicalization processes and transitions in a matched sample of female and male terrorist suspects and convicts (N = 26) residing in Dutch penitentiary terrorism wings. Results: Results show that both men and women often experienced discrimination. A subgroup of women grew up in a stressful family environment and lacked emotional support from their family, whereas the other women did not experience such circumstances. The majority of the study sample was susceptible to connecting with radicalized friends or family members. Interestingly, factors that initially led to radicalization (e.g., a utopian image of the Islamic State) could later turn out to be factors associated with abandoning extremism. Conclusions: In this study, differences in radicalization processes and transitional phases between women and men emerged. Men more often had police contact prior to a terrorism-related offense. Making an effort to right old mistakes seemed important in the radicalization processes of men, whereas women had a stronger desire for emotional support and were more driven by experienced trauma and feelings of loneliness.
