Abstract

Based on a popular initiative, Switzerland has introduced in its penal code much-debated provisions on automatic expulsion of persons of foreign nationality who have committed certain crimes. This raises the question of whether such expulsion is compatible with public international law in general and with the EU-Swiss agreement on the free movement of persons in particular.
